With that being said, the title of this article is “You were just involved in a Motorcycle Injury Accident; Now What? The title of the article speaks for itself.
I receive many calls from Bikers that are injured in Motorcycle accidents, and to be quite frank, it sometimes blows my mind, how stupid some people can be; Let me explain.
What would you do if you just had your received a gunshot wound? You would probably call 911 if you could, or transport yourself to a hospital, right?
In the case of a motorcycle injury accident, it would probably be safe to say that the smart thing to do after a motorcycle injury accident would be to call 911, or get transported to a hospital as soon as possible to get checked out, right? Obviously if the accident is severe enough other people will do this for you. I cannot tell you how many calls I get from guys who just did a swan dive over their handlebars, and just go home rather than go to the emergency room to get checked out. One guy actually had a punctured lung and had he not followed my advice to immediately go to the emergency room he could have died.
Let’s face it, if you are having trouble breathing, you cannot bend your knees, you have road rash, YOU NEED MEDICAL TREATMENT
What is the second thing you should do after a motorcycle injury accident? Well if you are smart either you or a loved one would call a competent motorcycle injury lawyer to deal with the legal issues involved in your injury accident, right?
Lately, I don’t know what it is, but I have been dealing with some bikers and motorcyclist who may have had their heads banged in the accident. We are talking about guys and gals who are jacked up in a motorcycle injury accident, their motorcycles are totaled, and they are shopping around for the cheapest lawyer weeks after their accident. WEEKS AFTER THEIR ACCIDENT! Would you wait weeks to go to the doctor if you are injured? Would you shop around for the cheapest lawyer? Probably not.
These guys and gals I am referring to have already given statements to the insurance companies which could adversely affect their cases, they learn the hard way that the insurance companies are not going to just wily nilly pay them for their cases, so they call me. In many cases they have already screwed their cases up, but I in most cases can salvage the damage they have caused to their cases.
It is imperative that you retain a lawyer in the first 24 to 48 hours after a motorcycle accident unless you physically are unable to do it. If you can’t do it yourself, have your relatives call me at 818-584-8831 ext. 1. I am not going to write a treatise as to why you need a lawyer in this article; you can read my other articles on the subject.
One recent example of a call that I received, involved a man who had a car turn in front of him while he was doing 55 miles per hour on Pacific Coast Highway. He flew in the air, and when he landed he did many flips with his body. He sustained a broken shoulder, head, and neck, and back injuries, road rash to his back which just had some recent tattoo work. He was hurting from head to toe.
The first thing he told me was that his wife already had a lawyer for a personal injury case that she had going, and that the attorney that was doing his wife’s case, was willing to do his motorcycle injury case for 25 and 1/3 percent contingency. I absolutely could not believe it. The guy without doing any research, was willing to give his entire case to a lawyer that probably does not know the first thing about motorcycle injury cases, swing arms, tracking on a motorcycle with frame damage, or the reasons why cagers cause ¾’s of all motorcycle accident cases; a lawyer who probably has never rode a motorcycle, and does not know the first thing about motorcycle injury accident cases.
I invited him to go to the 25 and 1/3 percent contingency attorney. I am not a salesman, I am an expert at what I do, which is personal injury cases, and motorcycle accident cases. If you want the best than you hire me, if not, than have at it. I am not a yellow page or biker rag lawyer .
If this guy wants to go retain a settlement mill to handle his case, more power to him. I will sometimes negotiate my contingency fee on serious motorcycle accident cases, but this guy rubbed me the wrong way. Would you rather get a $15,000 settlement, and get to keep $11,250, or would you rather get a $250,000 settlement or judgment, and get to keep $166,750? If you don’t care, than just hire anybody for your motorcycle injury case. Obviously I am just giving examples, and there are no guarantees on any particular case, but you get the message. Hire the wrong guy, and you get what you get.
Bikers that come to me, usually come by word of mouth and my reputation of being a very aggressive lawyer for my clients. I get calls from all over the nation, but I only handle motorcycle injury cases throughout the State of California. I do have friends in other States that are also good biker lawyers, and I am presently building a network of competent, reputable biker lawyers to refer out of State clients to. If your accident happened anywhere in California, I am your man. You see, I am a biker and a motorcycle injury lawyer. The proof is in the pudding.
Most motorcycle accident cases involve significant injuries and damages. You need a lawyer who knows how to present a motorcycle injury accident case at all stages of litigation up through trial.
In the end, I feel sorry for the guy who chose a non biker lawyer to handle his case, rather than an expert in motorcycle accident cases. He may get lucky and get a decent settlement or judgment, or he may get screwed.
Anyway……….. don’t mess around with your case. If you are in a motorcycle injury accident, you or your relatives should call me immediately, 7 days a week, 24 hours a day at 818-584-8831 ext. 1. Excellent article Norm. Hopefully, your good and expert advise will help somebody who has had a accident. I am not a lawyer but I recommend anytime a layman has to give a statement to any “insurance company” they hire a lawyer. Although, we pay insurance for years and may have never had a claim, the insurance companies pay as little as possible and try to avoid paying at all. Insurance companies are not people friendly.
I was hit by a truck while riding my bike to work 4 days ago. Do you know any experienced motorcycle injury attorney’s in the state of Massachusetts (Boston area) that you could recommend?

Good article. We have provide home care for injured accident victims and have heard a lot of horror stories about how these patients were screwed and settled for peanuts and now how life time difficulties because of their accident. So sad to think things could have been different if they had contacted the right lawyer right away.
