I am posting a video of a motorcycle accident that happened in Greece, below. It is amazing footage of an actual motorcycle accident. Based upon what I am seeing in this video, the guy is lucky to be alive. He could have suffered massive internal injuries, broken bones, brain injuries, or death.
I cannot tell for sure from the video, who was at fault in the accident, because the video does not show the status of the traffic lights or other factors. However, I think it is safe to say that the guy on the motorcycle probably had a green light and was nailed by a cager who ran the red. If there is anyone on here who can decipher what is being said in Greek, please post a comment and tell us what is being said.
I am not posting this motorcycle accident video just for the sake posting it. I am posting it to show you what as a biker lawyer and motorcycle accident attorney I hate to see more than anything, a rider who does not ride with proper attire. What is this guy thinking? He has no leathers on; he is riding his motorcycle while wearing tennis shoes, shorts, t-shirt, and no helmet. He should have denim jeans or leather on, including a jacket, boots, gloves, and if it were me, a helmet.

Damn! I don’t know what to say Norm, the guy walks around like nothing happened, not even a limp. Seems he lifted his left leg just before the impact. Probably the low front design of the car had something to do with it too.
I agree with your Norm…..folks we need to wear proper attire when we ride. I read a report recently that recommend lace up boots for riding. Pull on boots come off too easy in accidents. This rider is in dire need of a motorcycle safety class.
Its nice that you want less injuries for motorcyclists. I don’t know anybody that doesn’t. But don’t open the door for a negligent department of transportation or driver causes the death of a biker and the first line of their defense is that he should have had a helmet on.
Yes leathers and a helmet prevent road rash but at freeway speeds there is no real scientific evidence that helmets will prevent death.

I hear you Anthony, hell I fight these battles everyday. I do a ton of motorcycle accident cases. Bottom line is that a negligent cager is liable for all damages proximately caused by their negligence. I have not once seen a successful mitigation of damages argument, i.e. he should of been wearing a helmet, for the exact reason you stated. As a matter of fact, I would get that argument excluded on a motion in limine outright.
However, and this is just me, I would rather have a helmet on if I go down, and I sure the heck would recommend that everyone else wear one as well.
Legal arguments aside, it is better to keep they grey matter in your skull than out on the pavement!
