You ask, “how is my <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycle,” something almost every down motorcycle rider</a> asks after an accident.</p>
<p>Next thing you know you are in an ambulance on the way to a trauma center, you are in pain, you are scared, you ask how bad you are hurt, but the paramedic simply tells you to stay calm and everything will be okay.</p>
<p>Thousands of <a href="https://bikerlawblog.com/18-years-operation-victory-motorcycles-no/">motorcycle riders each year</a> face this same scenario. Most <a href="https://bikerlawblog.com/covid-19-bizzare-times-living-in/">motorcycle accidents</a> result in severe to catastrophic injuries. Many <a href="https://bikerlawblog.com/covid-19-bizzare-times-living-in/">motorcycle accidents</a> result in relatively minor injuries compared to those who have suffered catastrophic injuries. However most <a href="https://bikerlawblog.com/basic-explanation-of-motorcycle-related/">relatively minor injuries for motorcycle</a> riders are not the same as for victims of car accidents.</p>
<p>A relatively minor motorcycle accident might involve having road rash and a jacked-up knee, arm, shoulder or something like that. I have handled hundreds of motorcycle accident cases, and it is very rare that there will be minor injuries like what you can expect in a rear end or small impact car accident.</p>
<p>Before 2010, there were just a few of us real motorcycle accident lawyers advertising for motorcycle cases in California, who specialize in motorcycle accident cases.</p>
<p>Now let me get one thing straight, the California State Bar has certain specialties where attorneys with a minimum amount of practice time, can take a special test, and become a certified specialist pursuant to the California State Bar. The California State Bar does not certify personal injury, or motorcycle accident cases as a State Bar certified specialty. So, when I <a href="https://bikerlawblog.com/let-s-talk-real-no-b-s-motorcycle-riding/">talk about specialize in motorcycle</a> cases, I am not talking about State Bar certified specialty. What I am talking about is someone who has an expertise in a certain area of personal injury.</p>
<p>Someone like me who specializes in motorcycle cases, not only handles a ton of motorcycle cases, but they are also experts in all aspects of motorcycle accident cases. I have been riding motorcycles since I was a kid. I started riding Street <a href="https://bikerlawblog.com/happy-new-year-2020-from-the-biker-law-blog-by-california-motorcycle-accident-attorney-norman-gregory-fernandez/">motorcycles legally on the street at 17 years</a> old and have ridden all types of motorcycles on the street.</p>
<p>No matter what you are told, there is no way a generic personal injury attorney advertising for motorcycle accident cases, will be able to argue a motorcycle accident case, unless they are experts at riding motorcycles. It’s just not possible because without the first-hand expertise of starting a motorcycle, dressing for the ride, starting from a dead stop, shifting gears, riding in city traffic, freeway traffic, mountain roads, etc., you have no idea from a first-person perspective what a motorcycle rider faces. Therefore, there is no way you can be as good as an attorney who <a href="https://bikerlawblog.com/modern-motorcycle-features-make-riding-comfortable-safer/">rides motorcycles,</a> it’s as simple as that.</p>
<p>Imagine hiring an <a href="https://bikerlawblog.com/knee-replacement-hell-taking-off-motorcycle-approximately-5-months-norman-gregory-fernandez-california-motorcycle-accident-attorney/">attorney for a car accident</a> case, who does not drive cars. How is the car <a href="https://bikerlawblog.com/what-the-heck-san-francisco-s-sanctuary/">accident attorney supposed to understand what happened</a> in the car accident, without having a perspective of being an expert car operator.</p>
<p>You may be able to fake it in court, and try to imagine what it’s like to be able to drive cars if you cannot drive a car, but the jury is pretty smart and they will know you are faking it.</p>
<p>It’s the same thing with motorcycles, but even more complicated because with motorcycles there are no extra layers between the motorcycle rider other than what they are wearing, and the road. The only way to know how that feels is to actually be a motorcycle rider.</p>
<p>I’ve discussed this many times before, there is also a certain prejudice against <a href="https://bikerlawblog.com/basic-explanation-of-motorcycle-related/">motorcycle riders by not only law</a> enforcement, but by the general public, and jurors. Many of them think that riding <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycles is a dangerous activity, and motorcycle riders</a> taking the risk, should bear the responsibility of what happens to them.</p>
<p>It takes an expert to be able to cut through the prejudice and get the <a href="https://bikerlawblog.com/when-a-biker-and-motorcycle-rider-get-sp/">motorcycle rider</a> what they are entitled to in court.</p>
<p>I am an expert in motorcycle accident cases. I have been riding <a href="https://bikerlawblog.com/18-years-operation-victory-motorcycles-no/">motorcycles for over 40 years</a>. I have handled countless motorcycle accident cases. I am not a poser pretending to be a <a href="https://bikerlawblog.com/a-rider-and-passenger-die-in-motorcycle-accident-on-the-405-freeway-in-seal-beach-california/">motorcycle rider</a>.</p>

I am among one of the original few <a href="https://bikerlawblog.com/do-not-ride-your-motorcycle-in-the-state/">motorcycle attorneys in the state</a> of California that existed before 2010.</p>
<p>The American Bar Association asked me to give a speech at their 2010 convention about my motorcycle accident practice. The actual speech I gave is actually on the Internet and it is kind of an embarrassment to me. After that speech where I told the attorneys in the audience to pick something they like and apply it to their law practice. Instead, the American Bar Association put the speech on the Internet, and every Tom Dick and Harry rather than take their own hobby and apply their practice to it, instead claimed to now handle motorcycle accident cases because they saw my speech as a marketing niche for them. They totally missed the point of my speech. I actually created a bunch of competition for myself by giving that speech. I wish I could take it back, because unfortunately many <a href="https://bikerlawblog.com/motorcycle-safety-message-appearing-on-s/">motorcycle riders out there have been suckered into signing</a> up with these guys. It’s most probable that they did not get the settlement or judgment they should have gotten because they were with an <a href="https://bikerlawblog.com/knee-replacement-hell-taking-off-motorcycle-approximately-5-months-norman-gregory-fernandez-california-motorcycle-accident-attorney/">attorney that wasn’t an expert motorcycle</a> attorney.</p>
<p>As I have stated in previous articles you will see a couple of big firms advertising all over <a href="https://bikerlawblog.com/sturgis-motorcycle-rally-2021-vacation-without-wife/">motorcycle rallies,</a> motorcycle publications, and at motorcycle venues. They have hot young paid models at their booths. They give out trinkets, promise roadside assistance, etc. They are all just big marketing outfits. A couple that I know of simply either farm cases out to regular attorneys in return for a referral fee, or they charge regular attorneys for a geographic region for advertising purposes. Do you really want to put your <a href="https://bikerlawblog.com/beware-you-take-your-life-in-your-hands-at-most-california-indian-casinos/">life in the hands</a> of one of these marketing outfits? Would not it be better for you to have an expert <a href="https://bikerlawblog.com/california-motorcycle/">motorcycle attorney on your side that you can count</a> on?</p>
<p>Giving out trinkets that cost a couple of bucks does not make you an expert motorcycle accident lawyer. Stating you provide roadside assistance should be left to the experts like <a href="http://automotive.aaa.com/roadside-assistance.htm">AAA Roadside Assistance</a> who you know for sure will take care of you when you need help. Why would a motorcycle accident attorney be trying to lure clients by purporting to give out roadside assistance. Why don&#8217;t they make french fries and juggle as well. A real expert motorcycle accident attorney does not need to hire models and put on a carnival show at events and venues.</p>

<p>There has been an increase in the purchase of smaller Street motorcycles, as well as sport motorcycles, and a decrease in the sale of what I would call bagger or cruiser type motorcycles.</p>
<p>Guys and gals riding Street or sport types of motorcycles for some reason tend to be more aggressive when they are driving, then <a href="https://bikerlawblog.com/do-not-ride-your-motorcycle-in-the-state/">people riding the bigger bagger or cruiser style motorcycle</a>. I have been riding <a href="https://bikerlawblog.com/happy-new-year-2020-from-the-biker-law-blog-by-california-motorcycle-accident-attorney-norman-gregory-fernandez/">motorcycles for over 40 years,</a> and I understand the tendency to be more aggressive on a smaller more nimble motorcycle.</p>
<p>I just talked to a guy that was involved in a motorcycle accident on street motorcycle, and it was not a nice discussion. The guy was seriously injured, and it appears he was at fault in the accident.</p>
<p>Although you may hear many people say that you never forget to learn how to ride a bike, the fact of the matter is if you have been off your motorcycle for even a couple of weeks, it takes some time to get used to riding again, I don’t <a href="https://bikerlawblog.com/even-experienced-motorcycle-riders-need-to-be-careful-riding/">care how long you have been riding motorcycles</a>.</p>
<p>So, when you have a combination of people who have not ridden a motorcycle for a while, coupled with people on smaller more nimble sport and Street motorcycles, you have a <a href="https://bikerlawblog.com/do-not-let-your-brothers-or-friends-drin/">recipe for disaster</a> if you do not take it easy.</p>
<p>Many people who read the <a href="https://bikerlawblog.com">Biker Law Blog</a>, and who have read my articles, know my mantra about how to be safe on a motorcycle, “Always Ride Like You Are Invisible.” What this means is that as you are riding, pretend that the other motorist on the road cannot see you. This will make you much more safer than if you assume, they do see you.</p>
<p>If you are on a smaller sport or <a href="https://bikerlawblog.com/the-art-of-safely-riding-your-motorcycle-on-the-street-by-california-motorcycle-accident-lawyer-norman-gregory-fernandez/">street motorcycle,</a> take it easy. I know it is very easy to accelerate fast, <a href="https://bikerlawblog.com/the-fine-art-of-lane-splitting-while-rid/">split lanes,</a> and be more aggressive. Trust me when I tell you that you do not want to go down in traffic on the street. Often times these types of motorcycle accidents are catastrophic to the rider.</p>
<p>If you have been out of the saddle for a couple weeks or more, take it easy, get your skills back before you put yourself in a major traffic situation.</p>
<p>Here in Southern California where I live, when you get on the freeway during most times of the day, it is harrie on a motorcycle. The newer cars can easily do 100 miles an hour, and most cars are driving faster than 65 mph. In other words, you have to have your Shit together on a Southern California Freeway on your motorcycle.</p>
<p>If you have been out of the saddle for a couple weeks, practice on some sidestreets to get your muscle memory back venture out onto the freeway.</p>
<p>Take it easy out there. Although I am a motorcycle accident attorney, I do not like to see motorcycle accidents. I am a real motorcycle rider like you, and any real motorcycle rider hates to see other motorcycle riders go down on her motorcycles.</p>

We attorneys are Juris Doctors, who have gone to Law School for 3 to 4 year, then passed the hardest Bar exam in the nation and then specialize in different areas of the law just like medical doctors specializing in different areas of medicine. Attorneys who specialize in personal injury and let’s a motorcycle accident cases are different from attorneys who specialize in real estate.</p>

<p>Obviously, you will want to wear proper motorcycle riding equipment when riding your motorcycle. <p>Wearing proper motorcycle safety attire when riding on city streets is a huge issue when riding on city streets and is a major factor if you get into an accident. The only protection you have while riding a <a href="https://bikerlawblog.com/youre-motorcycle-accident/">motorcycle is what you’re</a> wearing.</p>
<p>As a motorcycle accident lawyer, and a personal injury lawyer, I have personally handled over a thousand injury cases over a 21 year plus legal career as an attorney.</p>
<p>For the most part most <a href="https://bikerlawblog.com/knee-replacement-hell-taking-off-motorcycle-approximately-5-months-norman-gregory-fernandez-california-motorcycle-accident-attorney/">motorcycle and car accidents</a> happen within a few miles from your house. This is no coincidence. The <a href="https://bikerlawblog.com/18-years-operation-victory-motorcycles-no/">operators of motorcycles</a> and cars tend to be more complacent when they are closer to their home. When they are familiar with the streets they are on, they tend to be less cautious. When you are less cautious, that’s when accidents will occur.</p>
<blockquote><p>For a <a href="https://bikerlawblog.com/10-important-motorcycle-safety-tips/">motorcycle rider the most important</a> thing you can do as a rider on city streets or any other type of highway, is to pretend like you are invisible. I repeat, pretend that you are invisible. If you act like nobody else on the road can see you, that in of itself will prevent 90% of accidents in my opinion.</p></blockquote>
<p>Many <a href="https://bikerlawblog.com/knee-replacement-hell-taking-off-motorcycle-approximately-5-months-norman-gregory-fernandez-california-motorcycle-accident-attorney/">accidents happen when a motorcycle</a> rider assumes that a car or other vehicle sees them. For instance, you can be riding down a street, and you see a car waiting to make a right turn out of a shopping center driveway. You obviously have the right of way because you are riding down the street in your lane, the other car is supposed to wait until you pass to make their turn, all of a sudden the car pulls out in front of you, you <a href="https://bikerlawblog.com/test/">hit the brakes hard</a>, you lay it down or slam into the car because you have no time to react.</p>

<p>Let’s say you are riding down the road, and you see an oncoming car in the left-hand turn lane. You assume they must see you because you are right in front of them, and then suddenly, they make a left turn right in front of you, and you either lay your motorcycle down or hit them.</p>
<p>In both of these instances, although the <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycle rider</a> is not at fault, the accident for the most part can be prevented if you assume the car that’s pulling out of the driveway, or the car that’s making a left-hand turn in the opposite direction, doesn’t see you.</p>
<p>There have been many studies on the subject and for some reason most motorists in vehicles sometimes referred to by motorcycle riders as (cagers), do not see motorcycles like they do other cars. For some reason the human mind either blocks them out, or in some way causes us not to see motorcycles on the road. Obviously once you become conscious of a motorcycle that’s riding near you if your in a car, hopefully you will pay attention to it and be careful. I am talking about the motorists who does not see the <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycle rider</a>.</p>
<p>It does not matter if you have the right-of-way, it does not matter if you are not at fault. What matters is if you’re able to go home with your motorcycle intact, rather than going to the hospital with a catastrophic injury.</p>
<p>If you ride your motorcycle defensively, and pretend that you are invisible, you’ll be much safer on the road.</p>
<p>I always recommend when appropriate, when you see a car about to turn out of the driveway either in front of you, or in the left-hand turn lane in front of you, to let off the accelerator, and cover your brake.</p>
<p>Covering your brake simply consists of putting your hand over the brake and putting your foot above the brake pedal if you do not have a coupled braking system. That way if you do have to <a href="https://bikerlawblog.com/watch-your-rear-view-mirror-when-coming/">stop suddenly you save</a> at least a half second or more which could be all the difference in an emergency situation.</p>
<p>When you are approaching a car that is about to turn our of a driveway or street on your side of the road, do not look at the driver of the car or the actual car, look at the wheels, especially the hubs, or the hubcap. If you see them moving hit the brake and stop unless it is not safe to do so because of the car behind you.</p>

<p>If it is not safe to stop, move into the adjoining Lane. You may also hit the horn and flash your brights to get the car that is about to turn of a driveway or streets attention.</p>
<p>If you see the cars wheels moving, there’s a good chance this driver does not see you and they’re going to turn out in front of you. It is better to be safe than sorry.</p>
<blockquote><p>I hit the horn quite a bit when I am not sure of what a <a href="https://bikerlawblog.com/make-sure-you-notify-the-department-of-motor-vehicles-if-you-sell-or-give-away-your-car-motorcycle-or-other-motor-vehicle-or-you-could-los-big-time/">car or other vehicle</a> may do, because I care more about myself, my passenger, and my motorcycle, then irritating somebody by hitting the horn. On some <a href="https://bikerlawblog.com/do-loud-pipes-on-motorcycles-save-lives/">motorcycles the stock horn is not loud</a> enough for vehicles with their windows rolled up to hear. There are plenty of aftermarket horn solutions for all types of motorcycles to remedy this problem.</p></blockquote>
<p>When you are approaching a signal and you see a car in the opposite direction in a left-hand turn lane, as I said above, assume they do not see you.</p>
<p>I also look at the wheels in this scenario, but I also looked at the car as well. In the <a href="https://bikerlawblog.com/what-do-i-look-for-in-a-motorcycle-car-o/">case of a car</a> making a left, just like I stated above, let off the throttle, and cover your brake in case you suddenly have to stop.</p>
<p>If you see the wheels on the vehicle turning as you are approaching, or you see the vehicle moving even the slightest bit, stop if you can. If you cannot safely stop, then you want to try to move to the furthest Lane away from the left-hand turn maker, hit your horn and flash your brights.</p>
<p>If the single is turning yellow, try to stop if you can safely do so. Often times cars will making a left-hand turn will automatically start turning when the light turns yellow, and with you on a motorcycle there is a good chance they’re not going to see you. What is more important, waiting a few minutes at a stoplight, or blowing through a yellow light? I cannot stress how dangerous cars making <a href="https://bikerlawblog.com/why-is-a-riverside-california-motorcycli/">left turns</a> in front of you are enough. Do what you have to do to survive.</p>

<p>In the vast majority of cases the car or vehicle may not turn in front of you, but if they do, you will be ready, you will know what to do, and you will go home safe with your motorcycle unharmed.</p>
<p>Keep your head on a swivel. This is not just some buzzword or term, it is a physical act which will <a href="https://bikerlawblog.com/education-and-training-will-save-your-li/">save your life</a>. I don’t care how busy you are, or how focused you are, the only way to <a href="https://bikerlawblog.com/how-to-safely-ride-a-motorcycle-in-turns-by-california-biker-lawyer-norman-gregory-fernandez/">safely ride motorcycles</a> on city streets is to keep your head on a swivel. You should be constantly scanning everything in front of you, on the side of you, and behind you through your rearview mirrors.</p>

<p>Sometimes on a motorcycle you get into what I <a href="https://bikerlawblog.com/mayday-mayday-this-is-the-people-of-the/">call a meditative state</a>. Even <a href="https://bikerlawblog.com/techniques-and-tips-for-new-and-experienced-motorcycle-passengers/">experienced motorcycle</a> riders have this occur. It’s almost like tunnel vision. This is kind of ok if you are on <a href="https://bikerlawblog.com/california-highway-patrol-officer-injured-in-motorcycle-collision-at-the-134-and-2-freeway-junction-in-glendale-maybe-the-accident-could-have-been-avoided-with-a-safety-device/">highways or freeways,</a> but it is a death trap on city streets and roads. Always scan your surroundings and your rearview mirrors when you’re on a motorcycle on city streets and roads.</p>
<p>If you see that a <a href="https://bikerlawblog.com/what-should-you-do-if-a-car-or-truck-is/">car is tailgating</a> you, put your left hand up, and then make a up down motion as though you’re pushing something down in attempt to get the car&#8217;s attention, and to get them to slow down.</p>
<p>Sometimes tailgaters intentionally tailgate because they are in a rush, they are not paying attention, or they could be in a <a href="https://bikerlawblog.com/my-fiance-and-i-were-the-victims-of-a-ro/">road rage</a> type of frame of mind. If the up-and-down motion with your left hand does not work to get them to back off, move to the other closest Lane as soon as and as safely as possible.</p>
<p>Make sure you use your <a href="https://bikerlawblog.com/why-is-a-riverside-california-motorcycli/">turn signal</a> first, because the tailgater may also have the same idea and suddenly change lanes into the same lane you are going into.</p>
<blockquote><p>I know you have the right of way, I know that you should not have to change lanes just because somebody is tailgating you, but sometimes even the toughest guys on motorcycles have to eat their ego to be safe.</p></blockquote>
<p>The theme here is it’s better to be safe than sorry. I have had to actually pull over in this scenario many times. It is okay if you are upset and angry. It is okay if it is not fair that you have to pull over or switch lanes. I understand you want to kick their ass. It’s a hell of a lot better to switch lanes, or pullover, then to be sitting in some trauma center. Beware of the tailgater.</p>
<p>The theme of riding your motorcycle safely on city streets and roads, is to act like you are invisible, and to anticipate that the other vehicles on the road with you, will do everything they can to take you out. If you see a tailgater, anticipate that he or she will <a href="https://bikerlawblog.com/3-phoenix-arizona-motorcycle-riders-mowe/">rear end</a> you. If you see somebody turning out of a driveway, or making a left-hand turn, assume they do not see you and that they will turn in front of you.</p>
<p>Do not tailgate cars while riding your motorcycle. Always leave a safe enough distance between the car in front of you and your motorcycle so that you can fully stop if the car suddenly stops. Anticipate that the car in front of you may suddenly stop.</p>
<p>Riding the speed limit is critical to being safe on city streets and roads when you’re on your motorcycle. Yes, we <a href="https://bikerlawblog.com/a-rider-and-passenger-die-in-motorcycle-accident-on-the-405-freeway-in-seal-beach-california/">motorcycle riders</a> can usually go a lot faster than cars. However, you may have noticed, that the cars these days are much faster than they used to be. Guys that are riding <a href="https://bikerlawblog.com/is-there-a-rivalry-between-cruiser-motor/">cruiser style motorcycles</a> will find that cars accelerate just as fast as you do from stop signs and turn signals.</p>

<p>City streets and roads are not speedways, they are a transportation medium only.</p>
<p>Motorcycles unlike <a href="https://bikerlawblog.com/make-sure-you-notify-the-department-of-motor-vehicles-if-you-sell-or-give-away-your-car-motorcycle-or-other-motor-vehicle-or-you-could-los-big-time/">cars or other motor vehicles,</a> only have 2 wheels for traction. Unlike car tires that are flat, almost all <a href="https://bikerlawblog.com/riding-your-motorcycle-around-curves-and-turns-without-killing-yourself/">motorcycle tires are curved</a>. What this means is that motorcycles may have 1 to 2 inches at the most of actual rubber on the pavement. Motorcycles cannot stop as fast as cars, nor are they as safe as cars in an accident scenario.</p>
<p>Riding the speed limit although boring at times, especially since motorcycles can accelerate very quickly, is a major factor in being safe on city streets and roads. You will find that if you ride the speed limit, you will be able to stop when you need to, you are less likely to get into a <a href="https://bikerlawblog.com/when-a-bad-road-causes-a-car-or-motorcycle-accident-in-california/">car accident</a>.</p>
<p>When approaching a <a href="https://bikerlawblog.com/it-looks-like-those-rip-off-red-light-ph/">red light</a> or stop sign, or slowing or stopped traffic, always look in your rear view mirrors to ensure that you are not going to be rear ended by a car or other vehicle that does not see you. Leave enough distance between the car in front of you, so that you can escape from your lane if you think you might be <a href="https://bikerlawblog.com/3-phoenix-arizona-motorcycle-riders-mowe/">rear ended</a> by the vehicle behind you. Basically make a lane escape plan each time you are slowing, or stopped, just in case. Leave your motorcycle in gear with clutch in so you can escape the rear ender fast if you have to.</p>
<p>Finally, there is the factor of not wanting to <a href="https://bikerlawblog.com/do-not-ride-your-motorcycle-in-the-state/">ride directly next to people</a> in cars, yet not being able to move away from cars because of traffic. Every <a href="https://bikerlawblog.com/modern-motorcycle-features-make-riding-comfortable-safer/">motorcycle safety course tells you to not ride</a> directly next to cars or trucks, etc. When you are on city streets and roads, in traffic, going the speed limit or stopped, there is no way to avoid other vehicles.</p>
<p>If I am forced to ride next to a <a href="https://bikerlawblog.com/when-a-bad-road-causes-a-car-or-motorcycle-accident-in-california/">car or vehicle on city streets and roads,</a> I always like to make sure that I am near the driver side window or at least up to the drivers window if the car is on the left-hand side of me, to make sure that the driver actually sees me.</p>
<p>Many times, you will see that the driver is texting on their phone, holding their phone up to their ear, with their windows rolled up, and they flat out don’t see or hear you. I will give my motorcycle a couple run of revs on the throttle to get their attention. Sometimes you don’t get their attention, but at least you tried.</p>
<p>If I see somebody texting on their phone or talking on their phone with the phone to their ear, I will hit my horn really quick to get their attention while I’m riding.</p>

<p>You’re used to driving late at night, even if you’ve had drinks with your friends. This has been your routine for years. No matter how drunk you are, you would always choose to drive home because, for you, you’d always want to sleep in the comfort of your own bed. And <a href="https://bikerlawblog.com/youre-motorcycle-accident/">you’re never worried about getting into any accidents</a> because in your defense, you’ve been doing this for years and nothing bad has happened to you. You’re still in one piece. You’re a grown man, and you believe you can still manage yourself while you’re on the road. And since nothing bad has happened to you in the past while you’re drink driving, you decided to continue doing your ways. But are you actually waiting for an <a href="https://bikerlawblog.com/a-life-changed-in-an-instant-the-anatomy-of-a-motorcycle-accident/">accident before you change</a> your mindset? Or are you forgetting that you’re also putting your health at risk whenever you drink drive?</p>
<p>Your life is the biggest thing you can lose once you <a href="https://bikerlawblog.com/do-not-let-your-brothers-or-friends-drin/">drink and drive</a>. This is common knowledge to everyone (hopefully including you). However, although you might not die immediately once you drink and drive, your health is adversely affected in the process. And the effects might not be visible in weeks or even in years but before you know it, your body may not be functioning well because you’re frequently drink driving. To create a clearer picture in your head, here are the real risks of drink driving to your health:</p>
<p><strong>Your eyesight will be affected:</strong> If you’ve been drunk many times, you might have felt that sensation of not being able to stand straight because everything you’re seeing seems to be tilting to one side. <li>No, you don’t have to visit your favorite ophthalmologist for a new set of glasses because your eyesight is not totally at fault why situations like these happen. You’re feeling this way because of alcohol. Aside from feeling dizzy, you’ll also have slower pupil reaction times which can become an issue as you’ll not be able to adapt to oncoming headlights while on the road.</li>
<li>You need your eyes to be alert while you’re on the road to determine if there are vehicles ahead or behind you, or if pedestrians are crossing the street. Once you’re not able to see these on your way, you could be involved in <a href="http://www.hasnerlaw.com/locations/savannah/">fatal accidents</a>.</li>
<li><a href="https://coopervision.com/blog/what-effect-alcohol-eye">One of the long-term effects of alcohol to your eyesight is decreased vision due to vitamin deficiency.</a> If you drink too much too often, your liver loses the ability to absorb the vitamins needed for your eyesight. <li>There’s a reason why you’re not allowed to wear your favorite iPod headphones while you’re on the road – so you can be aware of what’s around you to make better decisions while driving. If you can hear a vehicle’s honk as it’s planning to approach an intersection, you’ll be able to make a complete stop and make way for that vehicle.</li>
<li>But if you’re not able to listen attentively to these warnings, you won’t know what will happen next. And the effects that this has on you, and surrounding traffic, could be detrimental.</li>

<li>If alcohol is already in your system, you’ll lose the concentration and ability to think while you’re on the road. And these things are important to ensure your safety. You need to focus on what’s on the road, and you should be able to make decisions immediately whenever problems arise while you’re driving.</li>
<li>ou don’t want to blackout when you’re faced with a very stressful situation while driving. Unfortunately, this can happen if you’re always intoxicated. <a href="https://www.promises.com/eoa/">You can blackout and lose control of the wheel.</a></li>

<p>The risks of drink driving to your health should be reasons enough for you to change your mindset on what you think is right. Yes, you might get at home after a night out, but that doesn’t outweigh the risks – you don’t know what can happen on the road and the chances of you, getting any long-term illnesses are gradually increasing. Nothing good can come from either of those, right? Instead of driving when you’re drunk, consider asking a <a href="https://bikerlawblog.com/do-not-let-your-brothers-or-friends-drin/">friend to drive</a> you home or stay in a nearby hotel. Your life and safety should always be your priority, no matter what the situation is.</p>

<p>If you don’t already know, <a href="https://www.google.com/#q=memorial+day">Memorial Day</a> is not just about a day off of work, a barbecue with the family, a day at the beach, or a day of drinking. Memorial Day is a <a href="https://bikerlawblog.com/we-almost-died-in-big-horn-national-forest/">national holiday to honor those heroes who have died</a> in the service of the United States of America.</p>
<p>Somehow many people confuse <a href="https://www.google.com/#q=memorial+day">Memorial Day</a> with <a href="https://www.google.com/#q=veterans+day">Veterans Day</a> in that they honor those who served in the military, and those who have died in the military on this day.</p>
<p>This day is meant specifically to honor those who <a href="https://bikerlawblog.com/we-almost-died-in-big-horn-national-forest/">died in the service of our nation</a>. As a veteran myself, I do not mind honoring veterans, but this <a href="https://bikerlawblog.com/have-a-great-veterans-day/">day is not for veterans,</a> this day is for those who have died in the service of our country.</p>
<p>On this day, <a href="https://www.google.com/#q=memorial+day">Memorial Day</a>, May 26, 2014, we find ourselves still at war in Afghanistan, with troops deployed all over the world.</p>
<p>We have men and women still fighting and dying in Afghanistan, after 13 years of war.</p>
<p>The Afghanistan war, is the longest war in the history of the United States of America.</p>
<p>Memorial Day is a day to honor those men and women who have died from the Revolutionary war, all the way through to today’s wars.</p>
<p>When you go by any <a href="http://www.cem.va.gov/">National Cemetery</a> you’ll see rows of white headstones which marked the graves of many thousands of people who have died in the service of their nation.</p>
<p>Many people just drive by and not give a second thought.</p>
<p>I strongly suggest that you take you and your family to visit a <a href="http://www.cem.va.gov/">National Cemetery</a> sometime. Walk around the gravestones with your family, read the gravestones, and maybe you’ll understand just a little bit of the gravity of the sacrifice that our men and women have made in the service of the United States of America.</p>
<p>It’s one thing to put a uniform on and serve in the armed forces like me and many others have before me have done. It’s another thing to pay the ultimate sacrifice in the service of our nation.</p>
<p>It is important to know that you are able to live in the United States of America, and enjoy your lives in the United States of America, because of the sacrifices those brave souls who gave their lives in the service of our nation paid.</p>
<p>Maybe today you’ll take a few minutes to reflect on those who have given their lives in the service of our nation, and thank them for the freedom they have given you and all of us.</p>
<p>May God be with those who have given their lives in the service of the United States of America. God bless America.</p>

<p>The old saying what goes around comes around, is not just a saying, it is a fact.</p>
<p>I have been a biker and a motorcyclist for many years. I can recall many times where I had a problem with my bike on the road, and a fellow biker stopped and helped me out.</p>
<p>Bikers and motorcyclist for the most part are the friendliest and most helpful people you will ever meet hands down.</p>
<p>If you breakdown in a car forget it. If you breakdown on a motorcycle, chances are a fellow biker will <a href="https://bikerlawblog.com/what-do-you-do-with-your-hands-if-you-ar/">stop and lend you a hand</a>.</p>
<p>My opportunity to help out a fellow biker happened yesterday when I was going to my PO Box to pick up mail. I noticed an Electra Glide in a space, and I proceeded to park next to it.</p>
<p>I then saw a gentleman come out of the bank and hop on.  As I got out of my car I could hear him trying to <a href="https://bikerlawblog.com/how-to-safely-ride-a-motorcycle-in-turns-by-california-biker-lawyer-norman-gregory-fernandez/">turn on his motorcycle,</a> but it sounded like he did not have enough juice in the battery.</p>
<p>I walked in to get my mail. As I walked in I heard his motorcycle go click, click, click. I knew his battery was dead.</p>
<p>As I walked out I asked him “is your battery dead?” He responded “yes.”</p>
<p>I did not have any tools in my car, but I happened to have a hardcore battery charger and extension cord that I had recently used on my RV.</p>
<p>I told him that if he could get the seat off, I could give him a jump start. When I pulled the gear out of my trunk, he was amazed.</p>
<p>While he was pulling his seat off, I asked him if he has ever read my Biker Law Blog, he took a second look at me and said, “Yes, as a matter of fact, I just <a href="https://bikerlawblog.com/harley-davidson-king-tour-pak-premium-lu/">installed a Biketronics kit</a> in my motorcycle, and I read about it on your blog.”</p>
<p>He then proceeded to thank me for what I had written, as well as helping him with his bike.</p>
<p>After a short time, we got his <a href="https://bikerlawblog.com/when-a-bad-road-causes-a-car-or-motorcycle-accident-in-california/">motorcycle started and he was on the road</a>.</p>
<p>I have had fellow <a href="https://bikerlawblog.com/review-russel-day-long-seat-indian-roadmaster/">bikers and motorcycle</a> riders help me, and it felt good to help back. It was also rewarding to know that many of you have read my articles and learned something new.</p>
<p>If you ever see a fellow biker broke down on the side of the road, lend them a hand. Remember, what goes around comes around.</p>

<p>Some of these winners get on websites that allow consumers to ask questions of attorneys, then they go and try to handle cases on their own without an attorney.</p>
<p>Do these people realize why we personal injury attorneys exist? We exist because for profit <a href="https://bikerlawblog.com/the-dirty-little-secret-that-the-insuran/">insurance companies</a> will simply not give you what you are entitled to 99.9% of the time without an attorney.</p>
<p>The first thing they teach us <a href="https://bikerlawblog.com/real-truth-new-california-2019-motorcycle-noise-law-will-get-1000-fine-california-biker-lawyer-norman-gregory-fernandez-esq/">lawyers in law</a> school is never to represent yourself in a legal matter because you are emotionally biased, and the emotions will adversely affect your ability to handle the case. It is always best to have an independent <a href="https://bikerlawblog.com/never-represent-yourself-personal-injury-case/">person represent you in a case</a>.</p>
<p>Aside from the emotional aspects of representing yourself, do these people who want to play attorney and that try to represent themselves realize how complicated a real <a href="https://bikerlawblog.com/what-is-a-contingency-fee-in-a-personal/">personal injury case</a> is? Of course not they don’t. It would be close to impossible for an untrained person on their own, to prosecute a personal injury <a href="https://bikerlawblog.com/an-open-challenge-to-any-california-attorney-advertising-that-they-handle-motorcycle-accident-cases/">case through the court system without an attorney</a>.</p>
<p>I have been practicing 15 years and I can assure you that I have seen some lawyers who need to go back to school, let alone an untrained person actually doing it.</p>
<p>Personal Injury cases are complicated and no self-help book is going to give you the knowledge you need to handle one of these cases.</p>
<p>I see non-lawyers in Court all of the time getting hammered by Judges and getting sent packing because they did not do their cases right. In some instances non-lawyers get dinged with monetary sanctions against them because they do not know the law.</p>
<p>Then there is the matter of the cheapskates. These are winners who figure in their mind, hell; I am not going to <a href="https://bikerlawblog.com/i-am-really-sick-and-tired-of-ambulance-chasers-who-give-us-real-personal-injury-attorneys-a-bad-name/">give an attorney</a> a third of my case, so I will take all of the ,000 the insurance company is going to give me.</p>
<p>They <a href="https://bikerlawblog.com/never-represent-yourself-personal-injury-case/">don’t realize that their case</a> might in fact be worth ,000 to ,000, and even on the low end, they would have got two thirds of ,000 or ,675 with an attorney, as opposed to the ,000 they got sucked into accepting by the insurance company.</p>
<p>One of my sayings is that it is better to get two thirds of something instead of all of nothing.</p>
<p>To me this is plain stupidity, and there is a lot of it out there lately.</p>
<p>It does not make sense to me why a person would try to <a href="https://bikerlawblog.com/caveat-emptor-let-the-buyer-beware-picki/">handle their own personal injury case</a> without an attorney, when an attorney like me can be retained with no money out of your pocket whatsoever until a recovery is obtained.</p>
<p>The <a href="https://bikerlawblog.com/the-dirty-little-secret-that-the-insuran/">insurance companies</a> are constantly on the lookout for idiots who will accept the half payment of medical bills, or a token 1k to 2k to settle a case that might be worth tens of thousands of dollars, without an attorney.</p>
<p>Any insurance adjuster worth their weight in gold, loves talking to the stupid amongst us who for whatever reason, does not mind screwing themselves out of what they are entitled to by not retaining a <a href="https://bikerlawblog.com/i-am-really-sick-and-tired-of-ambulance-chasers-who-give-us-real-personal-injury-attorneys-a-bad-name/">personal injury attorney</a> like me.</p>
<p>Don’t be stupid, if you have been injured due to the negligence of another call an attorney, heck, call me.</p>

<p>The following news was reported today as a short blurb in the press.</p>
<p>Northridge – California A <a href="https://bikerlawblog.com/southern-california-motorcyclist-killed/">motorcyclist suffered severe injuries during a two-vehicle crash</a> in Northridge, California police said today.</p>
<p>The traffic accident occurred about 6 p.m. Friday at the intersection of Lindley Avenue and Rayen Street, according to the Los Angeles Police Department&#8217;s Valley Traffic Division.</p>
<p>According to police, Charles Giarratana, 62, driving a red Ford Explorer northbound on Lindley Avenue made a <a href="https://bikerlawblog.com/why-is-a-riverside-california-motorcycli/">left turn</a> onto Rayen Street where he struck David Landowski, 53, who was going southbound on Lindley Avenue on a white and purple-colored KTM 620SX motorcycle.</p>
<p>Landowski, a resident of Canyon Country, was transported to an area hospital with severe injuries. It was not immediately known if Giarratana, a resident of Reseda, was cited or arrested. Anyone who saw the traffic crash was asked to call the LAPD&#8217;s Valley Traffic Division at (818) 644-8036.</p>
<p>The only people who would probably read and care about news such as this are people that <a href="https://bikerlawblog.com/modern-motorcycle-features-make-riding-comfortable-safer/">ride motorcycles,</a> their friends and family, and the people in the article.</p>
<p>It is doubtful that average people would even read let alone care about a man on a motorcycle being hit by a negligent idiot in an SUV.</p>
<p>For me, a California Motorcycle Accident Lawyer and an actual <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycle rider</a>, this article brings forth many thoughts.</p>
<p>The vast majority of motorcycle accidents on city streets are caused by some idiot making left turns in front of or into a motorcycle rider because they do not look for motorcyclist, they do not see the motorcyclist, or they think they can beat the motorcyclist before they turn.</p>
<p>The innocent motorcyclist may not even see the <a href="https://bikerlawblog.com/a-negligent-driver-blames-sun-glare-in-f/">negligent driver</a> making the left turn until they are right in front of them, or not at all.</p>
<p>Their life is changed in an instant.</p>
<p>I wonder if David Landowski riding his KTM 620SX <a href="https://bikerlawblog.com/keep-your-eyes-and-your-ears-open-a-tub/">motorcycle saw Charles Giarratna turning before he hit</a> him? I wonder if Charles Giarratna has any clue what damage he has caused to the life of David Landowski simply because he did not look before he made the turn, or tried to turn before David rode past him?</p>
<p>Either way one thing is certain, David Landowski’s <a href="https://bikerlawblog.com/pfizer-vaccine-brought-life-back-new-type-normal-riding/">life will never be the same again</a>.</p>
<p>The newspaper article stated that David Landowski was transported to the hospital with severe injuries. I pray for him and his family that he will survive. If he does survive he will probably suffer months or even years of excruciating pain, loss of enjoyment of life, and emotional distress, not to mention loss of income, a career, or a job, tremendous medical bills, and maybe not ever being able to return to a <a href="https://bikerlawblog.com/pfizer-vaccine-brought-life-back-new-type-normal-riding/">normal life</a>.</p>
<p>Some riders such as David will never be able to ride a motorcycle again, some lose limbs, some suffer permanent debilitating injuries, and some never recover.</p>
<p>So the next time you read a little news blurb about some idiot making a left hand turn in front of a motorcycle rider and hitting him or causing the motorcycle rider to hit the car or truck because the car turned in front of the motorcycle, think about the fact that the motorcycle rider’s life was changed in an instant.</p>
<p>There is tremendous human pain and suffering, support to family lost, and life’s irreparably harmed in such little news blurbs.</p>
<p>The next time you are out riding in your car, SUV, truck, etc., look for us <a href="https://bikerlawblog.com/one-of-the-pleasures-in-life-being-a-motorcycle-rider/">motorcycle riders</a>. You do not want to have the thought of destroying someone’s life on your conscious.</p>

<p>It has been estimated that approximately 90% of all motorcycle riders are weekend riders only. That is, they only ride their motorcycles on Saturday or Sunday only.</p>
<p>I am not sure how true this statistic is, because I sure see a lot of guys and gals riding their motorcycles to and from work during the week.</p>
<p>Hell, in some cities like San Francisco, there are hundreds of <a href="https://bikerlawblog.com/a-simple-friday-after-work-motorcycle-ri/">motorcycles and small scooters parked in downtown during working</a> hours.</p>
<p>If the statistics are true that most people who ride motorcycles are weekend warriors, then that is a troubling statistic for me; here is why. The <a href="https://bikerlawblog.com/the-art-of-safely-riding-your-motorcycle-on-the-street-by-california-motorcycle-accident-lawyer-norman-gregory-fernandez/">art of riding a motorcycle</a> is in fact an art. The more you ride your motorcycle, the better you get at being a motorcycle rider.</p>
<p>Experienced <a href="https://bikerlawblog.com/modern-motorcycle-features-make-riding-comfortable-safer/">riders, who take time away from riding their motorcycles,</a> necessarily take time to become proficient riders again, and the only way to become proficient is to spend time back in the saddle.</p>
<p>Right now it is winter time and many <a href="https://bikerlawblog.com/how-to-safely-ride-a-motorcycle-in-turns-by-california-biker-lawyer-norman-gregory-fernandez/">motorcycle riders cannot ride</a> their motorcycles because of the weather. They too will need to take it easy when they get back on their <a href="https://bikerlawblog.com/riding-your-motorcycle-in-cold-weather-can-be-deadly/">motorcycles when the weather</a> breaks.</p>
<p>Therefore weekend warriors or people that have taken some time away from riding need to take it real easy when they get back on their motorcycles so that they can get used to riding again, even if they have taken 5 days off from riding their motorcycles in between weekends.</p>
<p>Another issue weekend warrior’s face is Sunday drivers; even Saturday drivers are Sunday drivers. What is a Sunday Driver? A Sunday driver is a driver of some kind of cage such as a car, truck, SUV, etc., that rides around on the weekends with their family in the vehicle, distracted by a family outing, and not paying attention for people riding motorcycles.</p>
<p>Therefore weekend warriors more than most motorcycle riders, need to take it real easy on their motorcycles. Do not speed, pay attention for cagers about to turn in front of you, and realize that your riding skills take time to come back after a 5 day absence from riding.</p>
