Well for those of you who know me, and those of you who do not, I have suffered most of my entire life with a bad left knee.

I remember the day I wanted to play pop Warner football when I was 13 years old for the Chatsworth Chiefs. My father told me, “Norm, if you play tackle football you will screw up your knees.” I told him in response, “dad, I will not screw up my knees.”

Boy was I wrong. After playing running back for 2 years of pop Warner football, and then 2 years of high school football, I tore two ligaments off the bone in my left knee during my second year in high school. That was not only the end of my high school football career dreams, but the beginning of a lifelong suffering with a serious bad left knee.

Back in those days, 1979-1980, they did not have the technology they have today. As a matter fact, had the injury I had back then, happened even today, it would be a career ending type of injury modernly. I remember the doctors told me I may never walk normally again. I remember in surgery, they gave me a spinal which numbs the bottom part of your body, and then I was given a sedative, I was not under general anesthesia. I woke up during the surgery and observed the surgeon with one of those hand drills about to go to town on my knee. I suffered extensively from this injury.

After 6 months in a cast after the surgery, in my 11^th grade year of high school, they cut the cast off. In those days there was no physical therapy, and I just winged it on my own.

The next year I managed to pass the US Air Force physical exam, and went to basic training rather than going to 12 grade in high school. In other words, I took the GED and skipped my last year of high school. On the first obstacle course in Air Force basic training, I jumped off a simulated cliff, and promptly tore my knee again.

I kept my injury in basic training hidden because I did not want to get kicked out of the Air Force and sent home. In fact, I should have never passed the Air Force physical to get into the military to begin with. The scars on my knee from my high school football injury were still pink and healing, and I had limited range of motion, but I managed to make it in and do my thing. In basic training my knee swelled up to the size of a basketball and I was in excruciating pain, but I kept it hidden. After basic training I went and saw an outside doctor who stuck a needle in my knee and drained it which was a big relief.

In the years after basic training, I managed to somehow just deal with the bad knee. I was in a combat communications squadron, and we were constantly in the field, but my knee held out.

Sometime around 1987-1988, I tore my knee doing a flying hook kick at my Tae Kwon Do studio. I ended up having a second knee surgery because of that. The doctor did the best he could, but he told me that eventually later on in life I would need a knee replacement.

Basically from the time I was 17 until now, I have suffered with the bad left knee which got so bad, that if I stood for longer than just a few minutes my knee would stiffen up and it would be hard to stand and walk, or even if I sat down for too long, it was hard to get my knee to bend to walk.

On a recent trip to Italy with my wife, the pain in my knee was so bad that I literally ended up in a wheelchair at the very end, I simply could not walk more than 20 or 30 yards at a time without having to sit and rest my knee. The pain was unbearable.

I knew it was time to get my knee replaced. I went to Sturgis this year in August 2021 knowing that I would have my knee replacement on September 3, 2021. I rode my ass off in Sturgis, but while at Sturgis I suffered with my bad knee.

I went in for my knee replacement surgery on September 3, 2021. The doctor told me that if my bones were good that they would use a titanium knee replacement system. As I sat there waiting to be called in to preop, I was thinking whether or not I should actually go through with this?

Before I had a chance to change my mind, they called me in. My wife was allowed to wait with me in preop until they came to wheel me into the operating room. When I got into the operating room there were a lot of people in there. They pumped me with drugs, and the next thing I knew I was waking up being told that it all went well, and that they gave me the Titanium knee.

I am not going to go into all the gory details when I was waking up, and the numbness from the spinal was wearing off, but I will just say this the pain was through the roof. One of the nurses was telling me that I would not feel pain for 24 hours. Hell, as soon the spinal started wearing off, I could feel the pain in the knee even while the rest of the legs were numb. They gave me pain medication.

I developed a situation where my pulse was around 135 and my blood pressure was high. I knew that was not normal and I told the nurses and my surgeon who came to see me that I was concerned. They ordered a CAT scan, and it turned out that I developed what is called a pulmonary embolism, or a blood clot that went into my lung. As I was laying there, I did not know how dangerous my condition was. If you Google it, it says that 25% of people with a pulmonary embolism in their lung die of sudden death syndrome. I do not know if the 25% figure is accurate but they immediately put me on blood thinners. As I laid in my hospital bed I had no clue how bad my condition was.

The nurses told me that I was on a dosage of blood thinners that was higher than they had ever seen anybody else have before. Frankly, the pain in my knee was so bad that I kind of ignored everything else that was going on. After a knee replacement, all everybody wants for the first couple weeks as painkillers.

I really feel bad for my wife who actually had to sit there and watch me go through what I did. If it was her in the same spot as me, it would have torn me up having to go home alone at night leaving her there in the hospital.

Suffices to say because of the pulmonary embolism, I spent 9 days in the hospital, and then went to a skilled nursing facility for an additional 2 1/2 weeks, not only for rehab, but because my house was under construction at the time and the doctors told us that I needed to be in a clean environment.

To top it off, at my postop appointment, it turned out that the surgical wound opened up because of the blood thinners, which I am supposed to take for the next 5 to 6 months to prevent another pulmonary embolism, so I have been basically been on my ass for going on 3 months now waiting for the wound to heal, and hoping to get off of the damm blood thinners.

The knee replacement has affected everything in my life including work. Luckily, I have a good staff, and even though I’m not supposed to be working for a while, I still jump in when I have to.

You may have read in my Sturgis article that I have a paint repair the needs to be done on my motorcycle, but unfortunately that will probably have to wait until I can ride again, so I can take the motorcycle to a shop. I may tow the motorcycle, we will see.

I can honestly say at this point right now that I never would have had the knee replacement had I known what was going to happen. Then again, my wife always reminds me how bad my knee was before the surgery, and she tells me that in a few months I will be happy with the results. Me being in the middle of it right now, I just want the damn thing to heal.

So, there you are, my knee replacement from hell. I have to thank my surgeon, because he was the one that discovered the pulmonary embolism and probably saved my life by ordering the CAT scan.

I thank all the medical professionals that have and are taking care of me right now. Modern medicine is something else. I was told by my surgeon that he only sees two patients a year that have the surgical wound open like what happened to me, so I guess I and one of the lucky two that has to deal with it.

As I write this article, I am very hopeful for a full in good recovery. Once the wound heals, I will be able to start physical therapy. I am looking forward to getting back in the motorcycle as soon as possible, getting back to my Wing Chun kung fu, and riding with the guys from my motorcycle club.

I know I have got a hard few months ahead but I will get through this. I have nothing better to do right now then to negotiate cases for my clients and get them great settlements when I can.

My wife and I purchased a new Indian Roadmaster in approximately June 2017. You can see the stock seat on the motorcycle in this picture. (click on any of the pictures to see large size)

We rode for one year on the stock seat with no problems, plus the stock seat which is Indian Tan in color, was custom in of itself, and an integral part of the motorcycle look.

I have owned many motorcycles in the past, and on every one of them I purchased an aftermarket seat. I always chose Mustang for my seats. Mustang is a one size fits all solution as is Corbin, although they do take special requests for custom seats.

On my last motorcycle, which was a 2008 Electra Glide Ultra Custom, I purchased a premium seat for it from Harley-Davidson, and sold the stock seat. The premium seat was just fine for the years I had the motorcycle.

My wife and I were at the Sturgis motorcycle rally in August 2018, and put over thousand miles on the Indian roadmaster at that time. Let me tell you something, the seat on the Indian Roadmaster became a brick. Whatever support and padding the seat had in it was gone within a year. and It became so bad, that both of our asses were hurting after each ride at Sturgis. It literally became torture to ride on the stock seat for extended periods of time.

I undertook looking for a new seat for the Indian Roadmaster.

I initially purchased a Mustang saddle for the Indian Roadmaster off the J P Cycles website, but the seat that I received was a different color brown than the Indian Tan color that is the color scheme on my motorcycle. Why would Mustang make a seat that does not match Indians color scheme? I immediately returned it.

My problem was not only that my tour pack back pad was Indian Tan, plus I have what is called Captain Inch heat shields for my motorcycle which are made out of leather, and they match the Indian Tan. I was not willing to replace all of that just for a new seat that was the wrong color. Plus, Indian Tan was the color I wanted not a dark brown it would take away the whole ambience of the bike.

No other motorcycle that I know of has the Indian Tan color on seats, that is exactly one of the reasons I love the Indian. The look sets it apart.

I talked to Mustang about their off color brown seat and they told me that usually their customers replace their stock black seats and the tour pack pad on the Indian all together to change from black to brown as a customization, and that their color was not intended to replace the Indian Tan color. What is bizarre is that they have Indian Tan for another model Indian, just not the Roadmaster. Anyway…….

They told me they could make a custom seat the same color as the Indian Tan, but they quoted me some exorbitant amount of money to do so. At the time of the writing of this article, which is a year and half later, they may have a matching seat now I’m not sure. Another thing to mention about a custom Mustang is that it was not a custom like the Russell Day Long, see below.

I looked at other options, and at the time there weren’t that many for the Indian. I looked at another manufacturer who sells one size fits all seats, but there were mixed reviews, and to keep my stock heating element that is built into the Indian seat, it would cost me just as much money to have a custom motorcycle seat made.

One thing I forgot to mention is that on the Indian Roadmaster, it does have a heated seat. Therefore, every aftermarket seat for this motorcycle is approximately $1000 plus or minus. They are expensive,unless you choose not to keep the heating. If you are going to pay 35k out the door for a motorcycle, why would you dump a feature like a heated seat?

After hours of research and one failed purchase that I returned, I chose to have a custom motorcycle seat made at Russell Cycle Products. Their seat is called the Russell Day Long.

One thing I should note about Russell Cycle Products, they can custom make a seat for you any way you want it, you can choose the type of covering material, the color, you can have custom stitching and embroidery, the sky and your imagination is the limit.

As for me, I wanted something that matched the stock seat as closely as possible.

What Russell does is they take your stock seat and make a custom seat from it utilizing you and your passenger’s measurements, your weight, and other criteria.

You can either order their seat by mail, and send in pictures of you and your passenger on the motorcycle, with precise measurements along with your old seat for customization, or for lucky people like me who live in the same state, or in other close by states, you can ride in and have a custom seat made.

Hell you can also take a road trip just to get your custom seat made at Russell.

If you want to ride your motorcycle into their factory, you have to make an appointment with them first and pay a small deposit to ensure you will show up. I had to reschedule my appointment one time and they accommodated me.. They contact you to confirm before your appointment.

Because of the special nature of riding your motorcycle into the factory to have a seat made, they say they require an entire day.

I made my appointment which was months in advance. They were busy 🙂 I also conversed with them back and forth via email. They told me that if I wanted the Indian roadmaster with a diamond pattern like the stock seat has, that they would need two days to do the seat. (Turns out it only took one day) I told them no problem, we would take our motorhome from Southern California, put the bike in the trailer, and stay overnight in a local campground. Their factory is near Redding California which is a beautiful area.

When the time came to go to the factory, we loaded up the motorcycle into our enclosed trailer, jumped in the motorhome and took off the night before. We ended up staying at a great campground just one freeway exit away from Russell’s factory.

We went to Russell’s in approximately December 2018 to get the seat made. I waited one year to write this review.

Russell Motorsports is in Northern California, whereas we live in Southern California. It is much colder in Northern California this time year, matter of fact some of the local mountains there had snow.

Many easterners will probably laugh at this part of the article but for a Southern California boy like me we are not used to snow, it is alien to us. Cold is alien to us 🙂

The morning of our appointment I was feeling a bit under the weather because we drove 12 plus hours in the motorhome, it was cold, and I was not feeling well , nonetheless, my wife and I took the bike out of the trailer and rode it to Russell Cycle Products for our appointment first thing in the morning.

When we got to the factory, everyone there was really cool. They opened a door on the side, and I rode the motorcycle in. They asked my wife and I what we weighed, and asked us to sit on the bike. They took pictures, and measurements. They also asked me to put my feet on the floorboards like I ride, and on the highway bars like I ride, and took measurements and pictures as well. It was a pretty quick process, they know their stuff.

They told us the seat would be ready the next day, so we took a Lyft back to the campground. I am an attorney, so I ended up working in the motorhome, my wife worked remotely as well.

The guys at Russell, called me a few hours later and told me the seat pan was ready and asked me to come down to sit on it to see if I wanted to make any adjustments. My wife and I took a Lyft back to the factory from the campground.

When I first sat on the seat, it felt like the padding was pushing up into my nuts and it was very uncomfortable. Good thing they had me come in for a test sit.

The fabricator took the seat pan in the back and shaved the padding in that area. He brought it back and it felt okay.

Frankly, I was feeling under the weather, and I had never done a custom seat like this before. When they ask you to sit on the seat without a cover, with just the padding, it was really hard to tell what it was really going to feel like. Nonetheless, we accepted it, and took a Lyft back to the campground so they could work on the seat.

Surprisingly, the guys at Russell called a few hours later the same day, and told us that the seat was finished. It was supposed to take two days to manufacture, but they had the fabricator, and the gal who did the actual stitching of the motorcycle seat in the factory that day, and they took the time and effort to get the seat done in one day, which my wife and I really it appreciated.

We took a Lyft back to the factory again. (By the way the Lyft driver was an older guy, it was his first day driving for Lyft, and it was kind of funny that he kept on picking us up)

You will see many pictures of the seat here at the precise moment I picked up the motorcycle. Other pictures were taken a year later.

First off, before I go into the next section of the review, I want to say that I care about looks, and function on a motorcycle. I feel the same way about my cars, that is why I only drive Mercedes-Benz.

There are some guys that care more about function. There are some guys that care more about looks. I have seen guys with literal bricks as seats on motorcycle’s, and they probably cannot ride more than 10 miles without taking a break, but because it looks really good, they keep it on their motorcycle.

The Indian Roadmaster is a $35,000 motorcycle out the door, and I get nothing but rave reviews about it’s looks wherever I go from Harley-Davidson riders and everyone else. Even 2.5 years later everyone gives me a thumbs up when they see the Indian Roadmaster. They love the look.

The stock Indian Roadmaster seat looks like a work of art, but it turned into a brick to ride which is why got the custom seat. Who cares if it looks good if it causes you pain to ride? It does have the Indian logo pressed in to the leather.

When I first looked at the Russell Daylong seat when I went to pick it up, my very first impression was that it simply did not look as good as the stock Indian Roadmaster seat.

It obviously had a bigger area for my butt, it obviously had more padding, the lower back support was much more substantial, however the thread that they use wasn’t as thick as the Indian thread. This was only a first impression, I since have come to love the appearance.

Secondly, the sides of the seat on the stock Indian Roadmaster actually have a piece of leather that hangs down a bit above the side covers and are attached via side bolts on inside of the side covers if you want to remove the seat. I never really liked the fact that you would have to remove the back screw and side bolts to get the Indian seat off, but hereto for I had never had to take the seat off.

On the Russell Daylong seat, they do away with the side bolts, and the piece of leather that hangs down above the side covers. I am ambivalent to this because now all I need to do is remove the back screw to get the seat off, plus it is easier to get the side covers off, and it is easier to polish the side covers. However, a trade-off is that there is no leather hanging down to cover the top of the side cover. For me it really doesn’t matter. Some people might like the aesthetics of the stock Indian seat better with respect to this regard.

If you take a look at the top picture with the stock seat and the pictures below it of the Russell Day Long, you can see on the side of the seat on the rider part, where the stock seat has the leather that comes down and kind of covers the side panel, whereas the Russell does not.

Now my first impression sitting on the seat was that I had made a big mistake. Rather than sitting in the seat like I did on the stock Indian Roadmaster seat, on the Russell Daylong I felt like I was sitting on top of it.

Further, it raised me up a bit which I did not like, however, it also pushed me back a bit which I liked. I always felt too cramped forward on the stock Indian Roadmaster seat. With the new seat I have more leg room now. (Turns out now that I am used to the seat, I like  that it raised me up a bit as I will discuss below)

The seat felt kind of hard, but it was not uncomfortable. I was thinking to myself, well they just destroyed my stock Indian Roadmaster seat, and now I might have to go get another one 🙁

The way they custom design the Russell Day Long, it also makes it harder for you to take your legs and put them on the side of the motorcycle seat like on normal motorcycle seats.

The reason for this is they make a very big distinct place for your ass which is a bit raised on the sides. You can see by the picture how wide it is where your ass is. You actually have to put your legs forward a bit to get your legs on the ground. It actually makes you feel like a kid at first. If you look at the pictures of the Russell seat you will see the area in the front there you put your legs down. It took me a while to get used to this.

Frankly, at first, I was not too pleased. I felt I had made a big mistake. When I rode the motorcycle back to the campground, my initial ride on the new seat, which was just a few miles away, I was disappointed. Now that I look back at it, it was simply a total change from the stock seat, and I was not used to it.

Turns out it was like walking in a new pair of shoes. They are not comfortable until you break them in and get used to them.

The guys at Russell specifically told me that the seat would not be totally broken in for the first 1000 miles. They told me if after breaking in the seat, I wanted to make adjustments, I could do so free of charge for 18 months.

When we got back to the campground, I kept the motorcycle outside of the trailer, thinking that my wife and I would take a ride. It was actually getting to be dark and very cold. We decided not to stay the second night and to just go home.

I got on the bike again to ride it into the trailer, and I was seriously thinking that maybe this was not the seat for me. We packed up the motorhome and went home that night. For us, it was a long 24 hours of riding in the motorhome.

Later, after a few rides on the new seat, I quickly changed my opinion of the seat. Turns out, the Russell Daylong is a great seat for riding your motorcycle. Not only do I feel no fatigue on this seat, but it is downright pleasurable to take long multi-hundred mile rides a day on my motorcycle in all weather conditions with no problem.

This seat gives a huge amount of lower back support which makes all the difference in the world when you are riding your motorcycle. Look at the pictures of the new seat on here. I could not imagine riding without the Russel Day Long seat now.

The issue of feet placement when putting your feet on the ground when the motorcycle is stopped, is not a problem now that I am used to it. I would rather have a great seat that is comfortable when riding, then have a trade-off of a seat that is easy to put your legs side to side when stopped but is not that comfortable to ride. You do not put your feet down when you are riding.

We took the bike to Sturgis, 2019, and did a lot of parading (stop and go for extended periods of time) with the new seat, I quickly got used to the new set up of putting my feet on the ground when the bike is stopped. We rode well over thousand miles in the week we were in Sturgis and Yellowstone in August 2019. Plus, we have ridden to many other places since.

On the issue of the seat raising you up a bit, I am 5’11,” and probably around 6’1” with motorcycle boots on.  Prior to getting the Russell Daylong I could easily get both feet on the ground by placing my legs on the side of the seat. The new seat, the way it was designed for my weight (I paid for the heavy weight spring), pushed me up one to two inches.

At first, I did not like not being able to have both legs on the side of the seat, with both feet stretched on the ground like you can do when your bike is real low.

I can still get both feet on the ground, but the seat is higher. I am quite sure Russell can make the seat lower you, keep you the same height, etc., but they used my criteria when I went to the factory.

Now, I like the seat a bit higher because when riding I have more leg room from feet on the floorboard to my body. So, what I give up when stopped which is not much, I now have more comfort when riding with more legroom on the bike.

The seat is broken in now, and I love it. No more wincing in pain at the end of a long day’s ride. I have no fear taking very long rides now.

While at the Sturgis motorcycle Rally 2019, we were at some gas station at a remote stop, and some guy came up to me and asked me what kind of seat I had. I told him it was the Russell Day Long. He told me he thought that’s what it was, and showed me his seat which was from the company that I was looking at prior to choosing  the Russell Daylong.

His seat did not have the stock heating because he did not pay for that option, which was available on his seat from that manufacturer, whereas I purchased the custom seat that retained the stock heating. His seat manufacturer (one size fits all design) offered keeping the heating which made it cost as much as the custom Russel Daylong.

Frankly, his seat did not look that good, I think the Russell Daylong looks better. I told him how I felt about my seat which at that point was a 10 out of 10 for rating. Hell we were in Sturgis riding hundreds of miles a day with no pain like the year before.

I should say that prior to leaving Russell Cycle Products for home, I picked out a custom embroidery design for my Rider back rest and left a deposit. It would take a week to do the custom Eagle embroidery, and we were planning on leaving the next day, however, we ended up leaving the same day as stated above.

I ended up shipping my stock rider backrest to them after I got home, they did the embroidery and new cover, and returned it promptly back to me.

When we got the seat, I ended up purchasing a seat cover from them as well, which we actually needed to use in Sturgis a few times because of the rain.

I have never used a seat cover on a motorcycle seat before, but the guys at Russell told me that any motorcycle seat has threading and stitches that create holes in the covering, and water will leak through the holes into the padding, which ends up destroying the inner padding, and decreasing the longevity of your seat.

I now use the seat cover while washing the motorcycle as well.

So, here is my final review of the Russell Daylong seat for the Indian Roadmaster. I give it a 10 out of 10. It cannot get any better.

Now that I am used to the look of the seat, but more importantly how comfortable it is while doing short and long rides, I could not imagine having to endure the pain of the brick which was the stock seat again.

I must mention my wife and how she likes the seat.  Many guys put their old ladies on a brick pad, hell I have seen guys make their old ladies ride on a friggen fender. If you want to take long rides with your women and hear nothing but bitching all day, then make her ride on the back of a bad seat. It you care about your woman and want her to be happy as well, get her a good seat to sit on.

My wife Little Teri absolutely loves the Russel Day Long saddle. As a back seat rider she says that she has no more fatigue or pain like she had on the stock seat. Further, she likes this seat better than the seat on my old Harley Davidson Electra Glide Ultra Custom. Russel customized the seat for her as well.

It was well worth the money and the trip to get a custom seat made by Russell Cycle Products if you are a motorcycle rider that rides.

If you do short bar hops and that is your thing, you may not need a seat like this. They do not call it a Russell Day Long for nothing.

I highly recommend getting one of the seats for any motorcycle.

My closing thoughts are that the guys and gals at Russell Cycle Products are geniuses when it comes to motorcycle seats. They have been making custom seats for many years and know exactly how to make a custom seat that fits your exact measurements and needs.

I have not been paid by Russell for this review, nor have I received any discounts or accommodations from them. This is just an honest review.

The worst possible scenario has happened. You are out with your friends having a great day riding your motorcycles, you are in a pack, next thing you know, some idiot in a car cuts into your lane and takes you out.

Next thing you know you’re lying on the pavement, in a state of shock with people standing over you, asking if you’re okay, telling you not to move. You ask, “how is my motorcycle,” something almost every down motorcycle rider asks after an accident.

Next thing you know you are in an ambulance on the way to a trauma center, you are in pain, you are scared, you ask how bad you are hurt, but the paramedic simply tells you to stay calm and everything will be okay.

Thousands of motorcycle riders each year face this same scenario. Most motorcycle accidents result in severe to catastrophic injuries. Many motorcycle accidents result in relatively minor injuries compared to those who have suffered catastrophic injuries. However most relatively minor injuries for motorcycle riders are not the same as for victims of car accidents.

A relatively minor motorcycle accident might involve having road rash and a jacked-up knee, arm, shoulder or something like that. I have handled hundreds of motorcycle accident cases, and it is very rare that there will be minor injuries like what you can expect in a rear end or small impact car accident.

Before 2010, there were just a few of us real motorcycle accident lawyers advertising for motorcycle cases in California, who specialize in motorcycle accident cases.

Now let me get one thing straight, the California State Bar has certain specialties where attorneys with a minimum amount of practice time, can take a special test, and become a certified specialist pursuant to the California State Bar. So, when I talk about specialize in motorcycle cases, I am not talking about State Bar certified specialty. Someone like me who specializes in motorcycle cases, not only handles a ton of motorcycle cases, but they are also experts in all aspects of motorcycle accident cases. I have been riding motorcycles since I was a kid. I started riding Street motorcycles legally on the street at 17 years old and have ridden all types of motorcycles on the street.

No matter what you are told, there is no way a generic personal injury attorney advertising for motorcycle accident cases, will be able to argue a motorcycle accident case, unless they are experts at riding motorcycles. It’s just not possible because without the first-hand expertise of starting a motorcycle, dressing for the ride, starting from a dead stop, shifting gears, riding in city traffic, freeway traffic, mountain roads, etc., you have no idea from a first-person perspective what a motorcycle rider faces. Therefore, there is no way you can be as good as an attorney who rides motorcycles, it’s as simple as that.

Imagine hiring an attorney for a car accident case, who does not drive cars. How is the car accident attorney supposed to understand what happened in the car accident, without having a perspective of being an expert car operator.

You may be able to fake it in court, and try to imagine what it’s like to be able to drive cars if you cannot drive a car, but the jury is pretty smart and they will know you are faking it.

It’s the same thing with motorcycles, but even more complicated because with motorcycles there are no extra layers between the motorcycle rider other than what they are wearing, and the road. The only way to know how that feels is to actually be a motorcycle rider.

I’ve discussed this many times before, there is also a certain prejudice against motorcycle riders by not only law enforcement, but by the general public, and jurors. Many of them think that riding motorcycles is a dangerous activity, and motorcycle riders taking the risk, should bear the responsibility of what happens to them.

It takes an expert to be able to cut through the prejudice and get the motorcycle rider what they are entitled to in court.

I am an expert in motorcycle accident cases. I have been riding motorcycles for over 40 years. I have handled countless motorcycle accident cases. I am not a poser pretending to be a motorcycle rider.

I will tell you flat out that there are fake poser attorneys all over the place in California, having their picture taken next to motorcycles, claiming to be motorcycle attorneys, who have never ridden a motorcycle, or maybe have ridden a motorcycle once or twice in their life. The American Bar Association asked me to give a speech at their 2010 convention about my motorcycle accident practice. They totally missed the point of my speech. I actually created a bunch of competition for myself by giving that speech. I wish I could take it back, because unfortunately many motorcycle riders out there have been suckered into signing up with these guys. It’s most probable that they did not get the settlement or judgment they should have gotten because they were with an attorney that wasn’t an expert motorcycle attorney.

As I have stated in previous articles you will see a couple of big firms advertising all over motorcycle rallies, motorcycle publications, and at motorcycle venues. They have hot young paid models at their booths. They give out trinkets, promise roadside assistance, etc. They are all just big marketing outfits. A couple that I know of simply either farm cases out to regular attorneys in return for a referral fee, or they charge regular attorneys for a geographic region for advertising purposes. Do you really want to put your life in the hands of one of these marketing outfits? Would not it be better for you to have an expert motorcycle attorney on your side that you can count on?

Giving out trinkets that cost a couple of bucks does not make you an expert motorcycle accident lawyer. Stating you provide roadside assistance should be left to the experts like AAA Roadside Assistance who you know for sure will take care of you when you need help. Why would a motorcycle accident attorney be trying to lure clients by purporting to give out roadside assistance. Why don’t they make french fries and juggle as well. A real expert motorcycle accident attorney does not need to hire models and put on a carnival show at events and venues.

I have never put up a booth at a rally or venue, nor do I need to advertise in Biker and Motorcycle Publications. I am known all over California for my Motorcycle accident expertise, and the riders come to me through word of mouth through the biker community. I think it is bad Karma to advertise like the other outfits do, it kind of makes me sick.

Where I am from in California, we have year-round riding, although many parts of California do not. Around this time of the year, when the snow has melted all over California, or is still in the process of melting in some places, I see an increase in motorcycle accidents, especially fatal motorcycle accidents.

There has been an increase in the purchase of smaller Street motorcycles, as well as sport motorcycles, and a decrease in the sale of what I would call bagger or cruiser type motorcycles.

Guys and gals riding Street or sport types of motorcycles for some reason tend to be more aggressive when they are driving, then people riding the bigger bagger or cruiser style motorcycle. I have been riding motorcycles for over 40 years, and I understand the tendency to be more aggressive on a smaller more nimble motorcycle.

I just talked to a guy that was involved in a motorcycle accident on street motorcycle, and it was not a nice discussion. The guy was seriously injured, and it appears he was at fault in the accident.

Although you may hear many people say that you never forget to learn how to ride a bike, the fact of the matter is if you have been off your motorcycle for even a couple of weeks, it takes some time to get used to riding again, I don’t care how long you have been riding motorcycles.

So, when you have a combination of people who have not ridden a motorcycle for a while, coupled with people on smaller more nimble sport and Street motorcycles, you have a recipe for disaster if you do not take it easy.

Many people who read the Biker Law Blog, and who have read my articles, know my mantra about how to be safe on a motorcycle, “Always Ride Like You Are Invisible.” What this means is that as you are riding, pretend that the other motorist on the road cannot see you. This will make you much more safer than if you assume, they do see you.

If you are on a smaller sport or street motorcycle, take it easy. I know it is very easy to accelerate fast, split lanes, and be more aggressive. Trust me when I tell you that you do not want to go down in traffic on the street. Often times these types of motorcycle accidents are catastrophic to the rider.

If you have been out of the saddle for a couple weeks or more, take it easy, get your skills back before you put yourself in a major traffic situation.

Here in Southern California where I live, when you get on the freeway during most times of the day, it is harrie on a motorcycle. The newer cars can easily do 100 miles an hour, and most cars are driving faster than 65 mph. In other words, you have to have your Shit together on a Southern California Freeway on your motorcycle.

If you have been out of the saddle for a couple weeks, practice on some sidestreets to get your muscle memory back venture out onto the freeway.

The most dangerous place to ride any motorcycle is on city streets and roads, whereas highways and freeways are the safest place to ride your motorcycle. Most motorcycle accidents occur on city streets and roads.

It is imperative as a motorcycle rider to understand how to actually ride your motorcycle on city streets in order to be safe.

Obviously, you will want to wear proper motorcycle riding equipment when riding your motorcycle. This article is not about proper motorcycle riding attire, if you want to look at that subject, simply search for it by going to the top of the page and typing in on the search box. Wearing proper motorcycle safety attire when riding on city streets is a huge issue when riding on city streets and is a major factor if you get into an accident. The only protection you have while riding a motorcycle is what you’re wearing.

As a motorcycle accident lawyer, and a personal injury lawyer, I have personally handled over a thousand injury cases over a 21 year plus legal career as an attorney.

For the most part most motorcycle and car accidents happen within a few miles from your house. This is no coincidence. The operators of motorcycles and cars tend to be more complacent when they are closer to their home. When they are familiar with the streets they are on, they tend to be less cautious. When you are less cautious, that’s when accidents will occur.

For a motorcycle rider the most important thing you can do as a rider on city streets or any other type of highway, is to pretend like you are invisible. I repeat, pretend that you are invisible. If you act like nobody else on the road can see you, that in of itself will prevent 90% of accidents in my opinion.

Many accidents happen when a motorcycle rider assumes that a car or other vehicle sees them. For instance, you can be riding down a street, and you see a car waiting to make a right turn out of a shopping center driveway. You obviously have the right of way because you are riding down the street in your lane, the other car is supposed to wait until you pass to make their turn, all of a sudden the car pulls out in front of you, you hit the brakes hard, you lay it down or slam into the car because you have no time to react.

Let’s say you are riding down the road, and you see an oncoming car in the left-hand turn lane. You assume they must see you because you are right in front of them, and then suddenly, they make a left turn right in front of you, and you either lay your motorcycle down or hit them.

In both of these instances, although the motorcycle rider is not at fault, the accident for the most part can be prevented if you assume the car that’s pulling out of the driveway, or the car that’s making a left-hand turn in the opposite direction, doesn’t see you.

There have been many studies on the subject and for some reason most motorists in vehicles sometimes referred to by motorcycle riders as (cagers), do not see motorcycles like they do other cars. For some reason the human mind either blocks them out, or in some way causes us not to see motorcycles on the road. Obviously once you become conscious of a motorcycle that’s riding near you if your in a car, hopefully you will pay attention to it and be careful. I am talking about the motorists who does not see the motorcycle rider.

It does not matter if you have the right-of-way, it does not matter if you are not at fault. What matters is if you’re able to go home with your motorcycle intact, rather than going to the hospital with a catastrophic injury.

If you ride your motorcycle defensively, and pretend that you are invisible, you’ll be much safer on the road.

I always recommend when appropriate, when you see a car about to turn out of the driveway either in front of you, or in the left-hand turn lane in front of you, to let off the accelerator, and cover your brake.

Covering your brake simply consists of putting your hand over the brake and putting your foot above the brake pedal if you do not have a coupled braking system. That way if you do have to stop suddenly you save at least a half second or more which could be all the difference in an emergency situation.

When you are approaching a car that is about to turn our of a driveway or street on your side of the road, do not look at the driver of the car or the actual car, look at the wheels, especially the hubs, or the hubcap. If you see them moving hit the brake and stop unless it is not safe to do so because of the car behind you.

If it is not safe to stop, move into the adjoining Lane. You may also hit the horn and flash your brights to get the car that is about to turn of a driveway or streets attention.

If you see the cars wheels moving, there’s a good chance this driver does not see you and they’re going to turn out in front of you. It is better to be safe than sorry.

I hit the horn quite a bit when I am not sure of what a car or other vehicle may do, because I care more about myself, my passenger, and my motorcycle, then irritating somebody by hitting the horn. On some motorcycles the stock horn is not loud enough for vehicles with their windows rolled up to hear. There are plenty of aftermarket horn solutions for all types of motorcycles to remedy this problem.

When you are approaching a signal and you see a car in the opposite direction in a left-hand turn lane, as I said above, assume they do not see you.

I also look at the wheels in this scenario, but I also looked at the car as well. In the case of a car making a left, just like I stated above, let off the throttle, and cover your brake in case you suddenly have to stop.

If you see the wheels on the vehicle turning as you are approaching, or you see the vehicle moving even the slightest bit, stop if you can. If you cannot safely stop, then you want to try to move to the furthest Lane away from the left-hand turn maker, hit your horn and flash your brights.

If the single is turning yellow, try to stop if you can safely do so. Often times cars will making a left-hand turn will automatically start turning when the light turns yellow, and with you on a motorcycle there is a good chance they’re not going to see you. What is more important, waiting a few minutes at a stoplight, or blowing through a yellow light? I cannot stress how dangerous cars making left turns in front of you are enough. Do what you have to do to survive.

The goal here is to pretend like you are invisible and do everything you can to anticipate that the car or other vehicle will in fact turn directly in front of you.

In the vast majority of cases the car or vehicle may not turn in front of you, but if they do, you will be ready, you will know what to do, and you will go home safe with your motorcycle unharmed.

Keep your head on a swivel. This is not just some buzzword or term, it is a physical act which will save your life. I don’t care how busy you are, or how focused you are, the only way to safely ride motorcycles on city streets is to keep your head on a swivel. You should be constantly scanning everything in front of you, on the side of you, and behind you through your rearview mirrors.

Sometimes on a motorcycle you get into what I call a meditative state. Even experienced motorcycle riders have this occur. It’s almost like tunnel vision. This is kind of ok if you are on highways or freeways, but it is a death trap on city streets and roads. Always scan your surroundings and your rearview mirrors when you’re on a motorcycle on city streets and roads.

If you see that a car is tailgating you, put your left hand up, and then make a up down motion as though you’re pushing something down in attempt to get the car’s attention, and to get them to slow down.

Sometimes tailgaters intentionally tailgate because they are in a rush, they are not paying attention, or they could be in a road rage type of frame of mind. If the up-and-down motion with your left hand does not work to get them to back off, move to the other closest Lane as soon as and as safely as possible.

Make sure you use your turn signal first, because the tailgater may also have the same idea and suddenly change lanes into the same lane you are going into.

I know you have the right of way, I know that you should not have to change lanes just because somebody is tailgating you, but sometimes even the toughest guys on motorcycles have to eat their ego to be safe.

The theme here is it’s better to be safe than sorry. I have had to actually pull over in this scenario many times. It is okay if you are upset and angry. It is okay if it is not fair that you have to pull over or switch lanes. I understand you want to kick their ass. It’s a hell of a lot better to switch lanes, or pullover, then to be sitting in some trauma center. Beware of the tailgater.

The theme of riding your motorcycle safely on city streets and roads, is to act like you are invisible, and to anticipate that the other vehicles on the road with you, will do everything they can to take you out. If you see a tailgater, anticipate that he or she will rear end you. If you see somebody turning out of a driveway, or making a left-hand turn, assume they do not see you and that they will turn in front of you.

Do not tailgate cars while riding your motorcycle. Always leave a safe enough distance between the car in front of you and your motorcycle so that you can fully stop if the car suddenly stops. Anticipate that the car in front of you may suddenly stop.

Riding the speed limit is critical to being safe on city streets and roads when you’re on your motorcycle. Yes, we motorcycle riders can usually go a lot faster than cars. However, you may have noticed, that the cars these days are much faster than they used to be. Guys that are riding cruiser style motorcycles will find that cars accelerate just as fast as you do from stop signs and turn signals.

City streets and roads are not speedways, they are a transportation medium only.

Motorcycles unlike cars or other motor vehicles, only have 2 wheels for traction. Unlike car tires that are flat, almost all motorcycle tires are curved. What this means is that motorcycles may have 1 to 2 inches at the most of actual rubber on the pavement. Motorcycles cannot stop as fast as cars, nor are they as safe as cars in an accident scenario.

Riding the speed limit although boring at times, especially since motorcycles can accelerate very quickly, is a major factor in being safe on city streets and roads. You will find that if you ride the speed limit, you will be able to stop when you need to, you are less likely to get into a car accident.

When approaching a red light or stop sign, or slowing or stopped traffic, always look in your rear view mirrors to ensure that you are not going to be rear ended by a car or other vehicle that does not see you. Leave enough distance between the car in front of you, so that you can escape from your lane if you think you might be rear ended by the vehicle behind you. Basically make a lane escape plan each time you are slowing, or stopped, just in case. Leave your motorcycle in gear with clutch in so you can escape the rear ender fast if you have to.

Finally, there is the factor of not wanting to ride directly next to people in cars, yet not being able to move away from cars because of traffic. Every motorcycle safety course tells you to not ride directly next to cars or trucks, etc. When you are on city streets and roads, in traffic, going the speed limit or stopped, there is no way to avoid other vehicles.

If I am forced to ride next to a car or vehicle on city streets and roads, I always like to make sure that I am near the driver side window or at least up to the drivers window if the car is on the left-hand side of me, to make sure that the driver actually sees me.

Many times, you will see that the driver is texting on their phone, holding their phone up to their ear, with their windows rolled up, and they flat out don’t see or hear you. I will give my motorcycle a couple run of revs on the throttle to get their attention. Sometimes you don’t get their attention, but at least you tried.

If I see somebody texting on their phone or talking on their phone with the phone to their ear, I will hit my horn really quick to get their attention while I’m riding.

I hope these safety tips will help you get home or to your destination on your motorcycle when riding on city streets and roads.

When a case settles, or there is a judgment, the attorney then pays a referral fee to this major firm that advertises. The other main player founded a group for clubs, etc., but none of their main attorneys who I personally know, ride motorcycles. In other words, all of these major players that you see advertising, are for the most part marketing scams, and do not have real motorcycle attorneys handling the cases.

I have been told that I am the top motorcycle and biker lawyer in the country by many people. I will tell you what, I will let my work speak for itself. If you retain me you will see for yourself.

Your brain will be affected: Your brain is in charge of everything that you say and do. Without it, you’ll not be able to do anything at all. Similarly, your eyesight and hearing will be useless if your brain can’t process the information it’s getting.

• Sure, you might see a pedestrian coming to your direction, but once your brain can’t process this information, you might not be able to step on the brakes on time. Your foot-eye coordination might be hindered for you to do anything.
• If alcohol is already in your system, you’ll lose the concentration and ability to think while you’re on the road. And these things are important to ensure your safety. You need to focus on what’s on the road, and you should be able to make decisions immediately whenever problems arise while you’re driving.

The risks of drink driving to your health should be reasons enough for you to change your mindset on what you think is right. In the past I have written extensively about Memorial Day on the Biker Law Blog. You can read a very large write up on the Memorial Day holiday I did in 2007 by clicking here now.

If you don’t already know, Memorial Day is not just about a day off of work, a barbecue with the family, a day at the beach, or a day of drinking. Memorial Day is a national holiday to honor those heroes who have died in the service of the United States of America.

Somehow many people confuse Memorial Day with Veterans Day in that they honor those who served in the military, and those who have died in the military on this day.

This day is meant specifically to honor those who died in the service of our nation. As a veteran myself, I do not mind honoring veterans, but this day is not for veterans, this day is for those who have died in the service of our country.

On this day, Memorial Day, May 26, 2014, we find ourselves still at war in Afghanistan, with troops deployed all over the world.

We have men and women still fighting and dying in Afghanistan, after 13 years of war.

The Afghanistan war, is the longest war in the history of the United States of America.

Memorial Day is a day to honor those men and women who have died from the Revolutionary war, all the way through to today’s wars.

When you go by any National Cemetery you’ll see rows of white headstones which marked the graves of many thousands of people who have died in the service of their nation.

Many people just drive by and not give a second thought.

I strongly suggest that you take you and your family to visit a National Cemetery sometime. Walk around the gravestones with your family, read the gravestones, and maybe you’ll understand just a little bit of the gravity of the sacrifice that our men and women have made in the service of the United States of America.

It’s one thing to put a uniform on and serve in the armed forces like me and many others have before me have done. It’s another thing to pay the ultimate sacrifice in the service of our nation.

It is important to know that you are able to live in the United States of America, and enjoy your lives in the United States of America, because of the sacrifices those brave souls who gave their lives in the service of our nation paid.

Maybe today you’ll take a few minutes to reflect on those who have given their lives in the service of our nation, and thank them for the freedom they have given you and all of us.

May God be with those who have given their lives in the service of the United States of America. God bless America.

As you all know, I drove my RV alone from Huntington Beach, CA to the Sturgis Motorcycle Rally 2013, in Sturgis, SD from July 31, 2013 to August 16, 2013. I also drove to Custer, Montana, and to Cody and Yellowstone, WY.

This marked my first big trip since becoming a single man again.

Once at my destination, I rode my motorcycle over 1000 miles. Below is a video montage of the pictures I took at the Sturgis 2013 Motorcycle Rally. A couple of pics had to be edited to add pasties so Youtube would not delete the video. On March 30, 2013, Alvaro Horacio Arroyo, was enjoying a day with his family.

He is pictured here on the upper left with his mother just 20 minutes before he was fatally injured in a motorcycle accident that was caused due to a negligent elderly person who made a left turn in front of him.

He was the jovial father of four sons, Alvaro – age 13, Alessandro – age 9, Ali – age 7, and Alden – age 2.

He was a loving husband to a blind and disabled wife Rosa.

He was a loving brother to Marisa, Nancy, Hector, Elmer, and Jesse.

He was a loving son to mother Agripina.

Alvaro was known as a kind and jovial person; the kind of person who made friends with everyone. He was the kind of person who made everyone laugh, and who everyone wanted to be around.

He was a role model to his children, and never balked at lending a helping hand to anyone that needed it, most of all his family.

On March 30, 2013, Alvaro decided to take his niece Bianca, for a ride around the block on his 2012, Yamaha YZF R6 motorcycle.

Bianca happened to be the primary caregiver for Alvaro’s disabled wife Rosa, and is herself also married with kids.

On that fateful day on March 30, 2013 as Alvaro and Bianca went for a short ride around the block where they lived, a car driven by a careless and  negligent elderly person turned left directly in front of them.

Having no time to react or maneuver or stop, they hit the vehicle.

Alvaro suffered massive head trauma and died of his injuries on April 5, 2013.

Bianca suffered severe injuries to her right leg, and the right side of her face which required multiple surgeries to both.

Her recovery will be slow and painful and she will need much more medical treatment and therapy to recover.

Rosa and Bianca now both need help living day to day, as well as their children.

The children of Alvaro and Bianca are suffering untold emotional distress, and at their young age do not really full comprehend the tragedy that has happened to the family simply because a negligent driver was not paying attention to what they were doing while driving.

Alvaro was a registered organ and tissue donor. With his wife’s approval, Alvaro’s organs were donated in an attempt to save other people’s lives. One Legacy he leaves is that he has helped other people to live by donating his organs.

This tragedy has left Alvaro’s family with no money to live.
