After Market Motorcycle Exhausts will become illegal under SB 435

Well, many of you have heard about SB 435, and many of you have not. California Senate Bill 435 will basically make it illegal to run with non stock exhausts on your motorcycles.

This bill passed the State Senate and is now sitting on Governor Arnold Schwarzenegger’s desk as I type this.

Our only hope now to get this asinine bill stopped is for the governor to veto the bill.

Every one of you should call, email, and write to Schwarzenegger NOW to get him to not sign the bill. Schwarzenegger is a fellow biker. Hopefully he will veto the damm thing.

If Schwarzenegger signs SB 435, it will become law. This law makes all 2013 and newer bikers without EPA stamped exhausts subject to fines of between $50.00 and $100.00.

On a personal note, I have never had a stock motorcycle with EPA stamps, so I have no clue how the hell the State is going to force manufacturers to put Federal EPA stamps on their exhaust systems.

I think this law is discriminatory on its face.

They say that since this is a secondary infraction, that the Police will be unable to pull over a motorcycle solely for an apparent exhaust violation, but I know that many bikers are being pulled over now for supposedly loud pipes.

You and I all know how this thing will play out. There will be some officers that will pull over any motorcycle that sounds loud, and they will ding the rider with a ticket if they cannot see the EPA stamp on the exhaust.

Frankly, I am so pissed off about this bill that I probably should not write anymore about it right now.

All I can say is that this is what happens when you get legislatures in office making more money than most of the people in the State, and with too much time on their hands.

Old Fashioned American Music

We Americans are unique amongst most civilizations throughout history. Our innovations and inventions are too numerous to mention here.

We also have several unique music styles that are ours alone. Amongst them is Bluegrass music from the Appalachian Mountains. My favorite Bluegrass musician of all time is Roscoe Holcomb. If this music does not get your dander up I do not know what will!

Yea many of you have never heard of him. I was first turned onto him when I was stationed in Texas in the Air Force.

Here are a couple of tunes by Roscoe Holcomb, may he rest in peace. This is what real country music sounds like. Not the crap you hear now. Enjoy.

An Open Challenge to Any California Attorney Advertising That They Handle Motorcycle Accident Cases!

*** 9/2/10 Update – As expected not one California attorney has accepted my challenge to meet me on a motorcycle ride anywhere in the State of California. Stay tuned. I am going to push this issue. There are a whole bunch of shysters out there advertising that they are lawyers who ride trying to get your business in motorcycle accident cases. There must be at least one out there who really rides right?

I challenge any California Attorney who advertises that they handle motorcycle accident cases to join me on a real motorcycle ride. That’s right a real motorcycle ride.

I will meet you anywhere in the State of California for a motorcycle ride, and I will buy you lunch.

If you are in fact a California Attorney who advertises that you handle motorcycle accident cases, and you actually really ride motorcycles like me, I will mention you here on the Biker Law Blog.

The only caveat’s are that you must have had a valid motorcycle endorsement on your California driver’s license before the date of this challenge; if it is your firm, you cannot push out an associate who rides, it must be you; you cannot hire an associate who rides after the challenge; and your advertisements must have existed prior to this challenge.

In other words, you have to actually do and be what you say you are in your advertisements on the date of this challenge.

We get about a million hits per month here on the Biker Law Blog so imagine all of the free advertising you will get simply by proving that you actually ride motorcycles like you advertise that you do.

You see I am flat out sick and tired of seeing all of the false and misleading advertising aimed at bikers and motorcyclist.

There are some firms that advertise in major motorcycle rags claiming that they are attorney’s who really ride or that they are the original attorney’s who ride, bla bla bla.

I say proof talks, bullshit walks, and enough is enough.

You would not hire a dentist to perform knee surgery on you, and you should not be hiring an attorney who does not ride motorcycles to represent you in a motorcycle accident case.

It just does not make sense to hire someone who does not know the first thing about riding motorcycles, or the bias and prejudice we face as bikers and motorcyclist face in the courtroom, to handle your motorcycle accident case.

Don’t sell yourself short by hiring an attorney to handle your motorcycle accident case, simply because they might have a fancy ad proclaiming that they ride motorcycles. Make sure they really ride motorcycles like they say they do!

So there it is; are there are real attorney’s here in California that ride motorcycles, and who advertise that they ride motorcycles, besides me? I would be shocked if there were more than one that I know of!

I hope the headline of this article got your attention.

The sad fact is that it is true. The bad economy that we are in right now can kill you or severely injure you if you ride a motorcycle, or are a motorcycle passenger.

You see, the streets, roads, highways, freeways, and interstates of cities, states, and our nation are falling apart, and are in a severe state of disrepair.

Many roads that you ride on have dangerous conditions such as potholes, significant cracks, debris, missing signs, or might even be in a dangerous state due to road construction.

I have represented many motorcycle accident victims whose motorcycle accidents were caused by dangerous conditions on the road.

Heck, in just the last couple of weeks, I have had multiple new motorcycle accident victims sign up with me, because they crashed due to dangerous conditions on the road.

Just recently, I watched a report on a local TV news channel about the fact that Los Angeles has a severe backlog of street repairs that need to be done, but that are on hold due to budget constraints.

They know about severe defects and are not fixing them. In some cases the streets are so bad, that they need to be replaced. Still they are doing nothing.

Well this is unacceptable. You see that the government owes each of us a duty to maintain our roads and highways in a safe condition, such that it is fit to be used in the manner in which it is intended.

Maybe instead of paying government workers six figure salaries, cushy insurance benefits and huge pension plans, that most people in private industry do not get, maybe they should take some of this money and fix our roads.

You see the government knows full well that if you have a road with potholes and other defects, that us motorcycle riders can and do hit these defects and crash.

There are many riders being severely injured and even killed right now, because our roads are not being maintained in a safe manner.

Maybe much of the so-called stimulus money should be spent fixing our roads and streets. Two birds can be killed with one stone; stimulate the economy and fix our infrastructure at the same time.

Getting back on subject, local city, county, and state governments are claiming that they cannot fix our roads because of the economy and their budget deficits.

Well guess what, they are still on the hook for negligence if their failure to fix a road or street, causes a motorcycle rider to crash.

Well it has been 40 something years since that sunny summer day in the sixties when my dad first put me on a mini-bike in the fields behind the housing development where we lived at the time.

I have ridden some form of motorcycle ever since.

I will admit that from time to time, especially when I was in my teens, and early 20’s, I was not so concerned about motorcycle safety.

Since becoming an attorney who handles motorcycle accident cases all over the State of California, and becoming a recognized expert on the subject of motorcycle safety, I figure I am really careful at least 99% of the time. The other 1% of the time I do foolish things like maybe crack the throttle and go real fast, or wear no helmet in States that have no helmet laws; stuff like that.

Well today I did a bonehead thing that could have cost me my life.

You see I have been to NBC studios twice in the last few weeks to be interviewed by an Emmy award winning news producer and her team, and to have action shots taken of me on my motorcycle. I am not going to go into any detail with regards to this piece, until it airs so don’t ask.

Today was the action shot day. So I woke up early, suited up, and rode my motorcycle to the NBC studios in Burbank. Hell I went straight to the A lot today, that is where the insiders get to park.

Anyway, back to the subject of this story. It was a real hot day today. It was in the 100’s. It was so hot that I had a gallon jug of water in my tour pak, and when I got home it was hot.

So as I left the NBC studios, the Alameda on-ramp to the 170 freeway was closed so I had to take a detour. I ended up on Lankershiem Blvd. in North Hollywood.

I got into a left hand turn lane behind a big ass truck that had multiple cars in front of it.  This was on old fashioned light with no green arrow. If you are lucky two cars can turn when the thing turns yellow.

The light turns green and nothing. We did not move. It was over 100 degrees, I had long sleeves on to protect myself against the sun, and I had a full face modular helmet on.

I knew if I sat at this light another cycle, I would start to severely overheat the way I was dressed. I decided to move into a traffic lane to the right, flip a U turn, and make a quick right.

Well this is where my life almost ended. I looked in my rear view mirror, did not see anything, and then flipped into the traffic lane to the right. Just as I got into the lane, there was a friggen car right there. In other words, I cut off a car that was doing at least 35mph, on my Electra Glide. Had the guy not been paying attention, had he not hit the brakes, had I not accelerated like a bat out of hell, I would have been toast on the hot pavement.

I fucked up and I know it. When I went to flip a U turn the guy passed me and gave me a hand signal which means “what the fuck” He put his hand out the window with the palm facing up. If you saw it, you would know what it meant. Anyway………….. Right after the incident, I thanked GOD for keeping me safe. I pray that way from time to time.

I analyzed what happened on the long hot ride back home. The first fuckup was that I was in too much of a rush to flip into the lane.

We riders of motorcycles do not get second chances like I got today. I was lucky. Next time I won’t be so lucky.

I should have not relied exclusively on my mirror; I should have turned my head to make sure the coast was clear.

A simple turn of your head can save your life.

The second thing I realized was that even though I feel that a full face helmet is the way to go for safety, it has an inherent flaw; it takes away your peripheral vision. Had I not had a helmet on, I may have seen the car. Then again, if the car had taken me out, I would have rather had the helmet on.

What lessen did I learn today that I am passing on to you; turn your head when changing lanes, don’t just rely on mirrors, turn your head, and take your time.

Yes it may be a little hot, or you may have to wait at a light in 100 degree weather. However, this inconvenience is better than ending up frying on the pavement in a pool of blood.

I got hitched

Well on January 30th, 2010, I married the love of my life Elizabeth.

If you do a search on here for “fiancé” you can find many articles that I have written that include her.

She has been an integral part of my life since 2001.

She has stood by me through thick and thin, she is my other half. She is the angel on my shoulder.

It is very rare to find a person that will stick by you no matter what. Elizabeth is that type of gal. We have had our ups and downs over the past nine years, but who hasn’t.

Hell on our first date, I picked her up on my motorcycle, and we rode to the Rainbow in Hollywood. She loved it. Since then she has been my backseat companion on rides for over a hundred thousand miles all over the country.

Everyone that has known me since 2001 also knows Elizabeth. She is always there with me on rides; she is my right hand, my sidekick. (She says I am the sidekick :)   ) While all of my brothers and friends ride by themselves all of the time because their old ladies do not like to ride, I got one who will not let me go without her.

She is something special.

Anyway getting back to the wedding story; we did our wedding the old fashioned way; I did not see her the night before our wedding. She stayed at a Hotel in her hometown of Burbank the night before. I stayed at our house.

We had a grand affair at The Castaway’s in Burbank, California, where the ceremony was held on the back patio with scenic views of the San Fernando Valley, followed by the reception in the Lagoon ballroom.

Both Elizabeth’s family and my family were present to witness the affair, along with colleagues and friends. We had about 200 people at the wedding. It could have been much bigger had I invited my many brothers from the motorcycle and martial arts world. We decided to keep it a small affair.

There were members of a few motorcycle clubs present at my wedding, all of whom came dressed in traditional wedding garb with no cuts. Hell some of these guys looked fantastic in shirt and ties; one even had a tuxedo on.

My groomsmen consisted of most of my law partners, and a couple of my very best friends.

The actual wedding started about 1 ½ hours late. Unfortunately I got stuck in traffic on the way to the wedding.

On the way to the wedding, there was actually a rear ender car accident two cars in front of me on the 5 freeway. Two days after the accident and my wedding day, the guy who got rear ended in the car with his family called me about his case, and I am now his attorney. No shit, talk about coincidence!

What are the chances of this guy calling me when I was only two cars behind the accident he was in! Anyway, my law firm and competent staff will take care of him!

Getting back to the wedding; it was great.

Since I was running late, I called Elizabeth who was busy getting ready at a nearby hotel with all of her bridesmaids, makeup and hair people, and the photographer. She was relieved since she was running late as well. Turns out neither of us slept very well the night before.

I finally arrived at Castaway’s an hour late. Yes traffic was bad. Most of the guests were still in good spirits. There was not a cloud in the sky and the view was fantastic. A couple of my friends were buying my mom drinks as well as themselves. Let’s just say that a few people were real tuned up when I got there.

I was walking around in my fancy tuxedo with tails and bow tie talking to people, while waiting for Elizabeth and her party to arrive. She was still running late. I guess the makeup artist and hair person had a hard time doing all of the girls in a timely manner.

I look at it this way; she waited 9 years for me, so waiting an extra hour for her was not a big deal. Let’s just say that I was not in my normal frame of mind the entire day. Most grooms know what I am talking about.

I finally received word that Elizabeth had arrived at Castaway’s with her wedding party.

We were told by the wedding coordinator to get in our positions. Myself, Reverend Don, and my groomsmen Lawrence A. Moy, Leonard E. Chaitin, Bud, and Scott Shaw lined up next to me. The audience got their cameras out and started to take pictures. Everything was great. However, Elizabeth was not coming out. My best man, and law partner Lawrence A. Moy went in to find out what was going on.

It turns out that Elizabeth had been up all night the night before, and she was not only sick with nerves, but she was freaking out inside Castaway’s. I guess she had looked through the glass, saw everyone outside and the crowd coupled with her being up all night really got to her.

So we stood there, and we waited; and waited; and waited. Finally The D.J. started to play “hear comes the bride” over the speakers. First her bridesmaids came out. Then, I could see her slowly walking down the stairs to the patio, with her cousin, who gave her away. The entire crowd had their eyes on her.

She looked awesome. This was the first time I had seen her in her wedding dress. She looked like the perfect bride. I took in her beauty up until she stood next to me. Then it was time for the nuptials. I was surprised that she grabbed my hand during the nuptials; I did not know that was allowed.

After the part where we both say I do, and I put her ring on, she started to wipe her eyes. There was a bit of a breeze outside, and I figured that she must have gotten something in her eyes. She kept on rubbing her eyes. I did not know it at the time, but she was crying. Stupid me, you see, Elizabeth never cries. She is one of the toughest women I have ever known in my life except for my mom and sister. I never see this woman crying.

All I can say is after the nuptials and the part where I kissed the bride, my damm mouth hurt from smiling so much. It was crazy. Too many people at the wedding, too many people wanting to take pictures.

Poor Elizabeth, there was a line of people wanting to congratulate her, and to kiss the bride. I had it no better, but luckily I did not have to kiss as many people as she did.

After doing all of the after nuptial greetings, all of the guests went into the Lagoon Ballroom. We were held outside by the photographer and the wedding coordinator. We were told that we were supposed to make a grand entrance in the ballroom after everyone had been there for a bit. Great.

It was kind of a trip doing the grand entrance into the ballroom, and being introduced as Mr. & Mrs. Norman Gregory Fernandez. I have been with Elizabeth for so long it just felt like a natural progression.

The reception was fantastic. Elizabeth and I had our own table at the head of the room, where we could observe all of our friends and family. Of course they could all stare at us as well. We had some good chow. Many of my groomsmen all had something to say with the microphone, and so did Elizabeth’s bridesmaids.

After chow, Elizabeth and I had our first dance to the theme song from the movie ”Titanic” with Selene Dionne. I could hear all of the females in the crowding oohing and awing. It felt good to dance with my new wife.

After that, everyone joined in on the dance floor. Eventually, someone started the ubiquitous conga line. I am not a conga line kind of guy, so I went back to my seat and watched the shenanigans while I sipped on some lemonade.

We then did the traditional cake cutting; Elizabeth threw her bouquet of flowers, I got the garter, and there was a lot of dancing.

Eventually the party died down and it was time for Elizabeth and me to depart as husband and bride.

Unlike most newlyweds, Elizabeth and I have had a rocky 8 months since the wedding. You see she is a first year law student. Now I know that there are many attorneys’s who read my blog. Anyone who has ever been through law school knows that law school is the worst friggen nightmare in history.

I have been through Air Force boot camp; I have been in the military. I used to play Varsity Football, and have done many sports in my lifetime.

Nothing was as difficult as going to law school for 4 years at night, working full time during the day, and then passing the California State Bar Exam.

Poor Elizabeth has been going through that nightmare since we got married, and even a few months before as well.

She is doing as well as can be expected. I am doing my best to support her. It will be dynamite when she becomes an attorney. It will be good to bring her on board in my law firm.

It took me a while, (9 years) and probably the longest engagement in modern times before I took the plunge and married Elizabeth.

I think I got lucky, but only time will tell.

8 People are Killed at an Off-Road Racing Event in Lucerne Valley; What are the Legal Ramifications?

Many of you have heard by now that 8 people died in the Lucerne Valley, at an off road racing event, when a truck went out of control during the event. Many of you may not know that 39 other people were injured; 10 seriously.

I personally send my heartfelt condolences to all of the family and friends of the victims of this tragic accident, and wish those injured a speedy recovery.

You can see by the raw video below that the spectators were standing way too close to the racing vehicles. Many have said that the reason why so many people were killed and injured was preciously because the fans were way too close to the action.

I have heard that there will be no charges filed against anyone having anything to do with the race, but that the national park service is going to do an investigation, since they were the ones that gave a permit for the race.

I have seen news reports that the promoters and organizers of this event put signs up stating that people should stay at least 150 feet away from the racing vehicles. I am sure they think that this warning is sufficient to protect them from being responsible for this horrible accident; I disagree.

As a Personal Injury Attorney, I deal with negligence cases in one form or another every day. The way I see it, the organizers and promoters of this event are legally responsible for the deaths of 8 spectators, and the injury of 39 others.

They owed a duty of due care, to provide a safe way for the spectators to watch the race. They should have had adequate security at the event to keep the spectators a safe distance from the race. The owed a duty of due care, to erect barriers, tape, or something so that spectators such as the ones who were killed and injured, would have known where to stand during the race.

They apparently did nothing but put signs up saying that spectators should stay 150 feet away from the action. Hell, I for one do not know how to measure 150 feet without some kind of tape measure.

Many might argue that the persons who were killed and injured assumed the risk of harm that they suffered at this event. I disagree. Spectators are not engaged in a dangerous sport, they are simply there to watch. With some minimal precautions from the organizers and promoters of this event, this tragedy could have been avoided.

Well tonight the new American Chopper, Senior vs. Jr. aired on cable TV. As far as I know it is now the only show on TV that features motorcycle customizers. 

I must admit, I enjoy this show, that is why I watch it, and that is why I write about it. It is basically a soap opera for bikers, but I don’t care. It is better than watching “Cake Boss.” 

As far as tonight’s debut show, some things were revealed. Sr.’s lawsuit against Jr. is real. The brothers had not talked to their father for over a year until they talked to each other on a radio show, and it appears, the father truly wants his son’s to come back to the shop so long as they respect him. 

We saw Jr. spending his dough to either buy or lease a building for his new shop, and we saw the return of Vinnie, who will apparently now go to work for Jr. I guess Vinnie’s own custom motorcycle shop that he started with Cody is no more. 

I don’t care what anybody say’s, this show is entertaining, even though it is basically the same old show. 

At least now we will get to see Jr. building motorcycles again, instead of designing doggie parks pro bono for the city. 

If you read between the lines you will see a few things; these guys are making a lot of dough doing what they do. It may have been a forgone conclusion that OCC would have gone out of business had the show not continued, especially in this economy. 

But get one thing straight, these guys are major TV stars with a huge following. The most viewed article on the Biker Law Blog was one of my articles about American Chopper. The article has had almost 250k unique hits and 133 comments.

Apparently I am not the only one that watches this show. 

No matter what you think, you have to admit one thing; it is good to at least have one show on TV about motorcycles.
